Just an update on this.- plus I need to vent further ....

He paid the other 20% owing on the July rent a few days later and we issued an eviction letter asking him to leave by end August 2009. He then goes to his lawyer who advises him of his squatting rights and has the *cheek* to offer me two options :

1. They'll leave end August 2009 as requested, but will not pay rent (deposit covers). The issue with this if water and lights - and also any damage that is caused is extra (though I'll list him as non-payer in this case)
2. Both parties can try again, sign a debit order for the 1st and run it for the remainder of the lease with no further issues.

I selected option 1 and said I just wanted him out ; I'll forfeit the money, as long as he gets out. He agreed he'd leave, the house was advertised and all seemed great.

Two days ago the agent took someone look at the house and there was no sign of moving - nothing packed etc. I asked her to confirm what the guy was planning and a massive surprise, he couldn't get a place for September and requested another month.

With my permission the agent and I agreed that if stays, the money for August needs to be in my account by COB today (this was discussed yesterday).

The tenant said he couldn't make today and will deposit on Thursday. I have not chatted to him for a few months because I get highly aggitated - BUT this time I was fuming with his negotiations and decided to phone him directly.

I said to him NO MORE NEGOTIATING - either COB today or get the **** out the house by end August. I'm not accepting other dates or excuses. After fighting and arguing over the phone, he agreed to leave end August.

I foresee drama over the weekend as I doubt he's going to move (or he'll trash the place) - so I've decided that if he's still there, I'll hold a braai/party with loud music on the property and get a few roudy guys get drunk etc.

I may even get a few guys to stay on the property in the backroom *shrug*

Most of you know my renting woes by now.

We're draftng an eviction letter as we speak. This guys has messed me around over 5 months and this month was the last straw.

I asked my rental agent to list them on ITC for breaching and non payment and there was a silence. After a while she said, 'we can if you really want to, but the next time he attemps to rent anything they'll instantly be refused' and mentioned that we could do at anytime if we want.

Do you think I should actually care about him and his family? :/ I'll be honest - I couldn't actually believe what I heard!

If someone can't get it through their head that "a place to stay" aka "a roof over your head" is the most important thing in life, then they deserve to learn the lesson and learn it HARD.

List them, evict them and hopefully they'll walk away smarter people...

Naw dude, if he trashes the place just take your loss....

If he doesn't move, wait till he leaves the premises. Take all of his stuff out put it infront of the door (or outside the gate) and change the locks.
 
And a further update :

The tenant has left the building :) :) :) Seems to be in tact as well ... just 2 or 3 smaller things to sort out.

use TPN for credit checks. add their disclosure clause to your lease agreement and manage your new tenants that way-final demand letters etc. u can use them once-off or pay a subscription.

I did - I had someone do full credit checks, reference checks, paylstips etc. Pretty much everything checked out perfectly and they seemed the ideal couple.

They have been listed on TPN as late payers after a letter of demand and final letter of demand in July. They do still owe me money - so perhaps I'll list them on ITC as well. I'll see how I feel.

For now though, they're gone :) :) :)

That was next plan ;) I had arranged a few of my brother loud friends to join in this weekend - but alas, they never caused issues.

I would warn you though that this could have been much, MUCH uglier (believe it or not) ...have you considered that you maybe don't have the stomach for this type of thing? It seems that a simple business transaction gone sour has affected you emotionally to some degree.

Also: why the hell are you so involved when you are (I am assuming now) paying an agent do do all of this stuff?

I have 2 properties that are rented out through an agency - one I have visited once when I bought it, the other I have owned for two years and never even seen.

I have 2 properties that are rented out through an agency - one I have visited once when I bought it, the other I have owned for two years and never even seen.

the problem is that some agents don't want to have to use their attorneys I assume cos of cost concerns. so they advise against the legal route and then get you emotionally and financially involved. it sux really.

Aside from that, it's not their money ... they're not the ones forking out cash for others to sit and use the place. I'm paying about R1,500.00pm for them to make use of the place - and losing out on R8,500.00 rent as well.

The agent is trying to manage and get job done, but it's *my* R10,000.00pm ... so I've got a bit more of an interest and more to lose. If I see she's being soft in a certain situation, I'll phone him directly.

As I said in an earlier post, I have an interest and I've been fscked around for 5 months. I wanted to list him and kick him on the street straight away.

Currently he's listed as a later payer. He does owe me more money though, and then I'll get him listed on ITC
