Need some advice...

Hi,

Last year December, I baught myself a AMD Phenom 9500 quad core. I already had a ASUS M2N WS32 Professional (which is a extremely good AM2 board) with my AMD Athlon x4 6400. The processor was getting a bit slow however and I wanted to upgrade it. I was told that the Phenom 9500 with a BIOS upgrade would work.

ASUS released a BIOS Update for the M2N WS32 Professional to enable it to support the AMD Phenom processor, and whilst it is a AM2 motherboard, I was assured by my reseller as well as his distributors (Frontosa) that the board WILL support the Phenom which is a AM2+ processor. Naturally, it didn't work, otherwise I would not be here typing this.

The reseller as well as Distributor on multiple occasions prior to purchase, confirmed to me that the processor + board, WILL work... Today, they changed their story and said it 'might not work'.

It would look to me that the ASUS BIOS Update is having issues, allot of people all over the world are complaining now about incompatibility issues between the Phenom and the M2N WS32 Professional. The supplier as well as distributor has also been made aware of this.

It's been a month now since I paid for the processor, and at this stage, I am yet to see the processor. I do not even have the chip, nor do I have my money, and I am basically at the point of taking the reseller to court for selling me the processor under false pretences that the processor works with the board, and also in a attempt to get the reseller to refund my money that I paid for the processor (R2360 excl.) Him getting a refund / credit from his Distributor is between the Reseller and Distributor naturally. As I paid the Reseller, I must take action against the Reseller.

The distributor now today came back to the Reseller, and MAGICALLY they want to (Free of charge) exchange my 13+ Month old ASUS M2N WS32 Professional which is flawless but out of warranty, with a brand new MSI K9A2 which supports AM2+ processors...

I'm asking myself, whats the catch here? Why exchange a old out of warranty motherboard which does not have any faults, with a brand new motherboard. Why not just credit / refund the CPU?

Am I right in suspecting there is something fishy going on here? It is starting to look to me that for SOME reason, the distributor is extremely afraid of taking the processor back, and if the distributor does not want to take the processor back for what ever reason, should I not have very valid concerns about purchasing the processor to begin with?

Now I know the M2N WS32 Professional is a very good board. When I baught it, it was also a very expensive board, and for the 13+ months I've been using it, it's been working flawlessly without -any- issues. Do I exchange my M2N WS32 Professional for the MSI K9A2, do I push for a refund of the CPU and take the matter to court if needs be? The fact that they are prepared to basically give me a new motherboard free of charge, is scaring me. Are they that desperate NOT to take the processor back???

PS: For respect to the owner which I know quite well, I am not naming the reseller. Distributor has been named...
 
Well the distributors has FINALLY agreed to credit either the CPU or swap my motherboard out, naturally I told the reseller to go for the credit and in turn he can then refund my money...

Not being too fond of AMD, I'm rather going to use the money (plus a bit extra) and get me a Intel Core 2 Due with a new Intel board...
