So I bought myself a 1tb Seagate at the past Esquire sale. I've noticed a few things. It is my secondary SATA drive and it keeps shutting down and booting back up only when I try to access the disk. I know this happens with IDEs, but not sure about secondary SATAs

Also it makes some scratchy noises while im using it and a loud one when booting up. Is this normal? It sounds like those old IDE drive noises. Am I allowed to return it just based on the scratching noises?

Use Seatools and run a complete diagnostic/full scan - if it picks up a problem then you'll have no problem returning it for a warranty claim. If not, its pot luck whether a claim of noises would be sufficient for them to replace/repair. Either way excessive noise usually indicates a problem with the drives heads and imminent failure.

It depends on what the noise sounds like and may be normal when compared to older drives. It depends on each individual drive's construction etc. Best to get an opinion or take it back just in case.

I think you would struggle to do a warranty claim for scratchy disks :D Rather download Seatools and find out if something is physically wrong....
