Ok, how about this...
Its 3am, I've been looking after my mates, haven't had a drop to drink, but whilst out I had a drink spilled on me. My clothes are now dry, but I will absolutely stink of booze. My eyes are bloodshot, and I'm unsteady on my feet because I'm absolutely shattered as well.
You're tired. You are putting yourself and all your mates in danger as well. A bit silly getting behind the wheel feeling like that.
Not going to deny that in the slightest.. but I could get arrest for "driving under the influence of alcohol" even when I haven't had a single drink... does that seem even vaguely legal to you?
What about breathalysers?
Or you have a stroke while driving, drive into a lamppost, and instead of getting an ambulance for you, the police lock you up for the night so you can sober up. This actually happened to someone I know. The symptoms of having a stroke can be quite similar to being drunk - slurred speaking, unbalanced, uncoordinated etc

Cape Town - The husband of Cape Town Mayor Patricia De Lille was arrested for reckless and negligent driving on Friday but apparently had suffered a stroke while driving in Pinelands.
De Lille said her husband had been arrested but that officials called an ambulance when they saw that Edwin De Lille was disorientated and confused, reported the Weekend Argus.
“The officers who arrested him said my husband did not know where he was. I took him to our house doctor who in turn managed to stabilise my husband’s blood pressure,” said De Lille.
It was his second stroke in three weeks, she said.
He was receiving medical attention.
De Lille rushed back to Cape Town after attending a meeting in Stellenbosch after learning of the incident.
