I got my Nokia X3-02 the end of February. In the last 5 months I already took it back twice to vodacom. Both times they gave me a new phone.
But now this phone still have the same problem.

1) Touch screen doesn't respond when receiving calls.
2) Can not end call if call goes to voice mail. I have to take out battery.

Now I have emailed Vodacom and Nokia and both only say that I have to take it in again. But really, I am not happy with this phone and I can not find anyone to talk to about this problem.

I know about the new law, but it only cover people who got there phone after 1 April.

I really need some advice. Please help...:(:(:(:(:(:(
 
So they gave a brand new phone, twice? By the second time, you should have told them you want a different phone. Don't get caught out a third time.

And are you sure they gave you a "new" phone both the previous times, and not just your same phone? Maybe they didn't even try to repair it? Get a brand new phone (Blackberry, HTC, whatever) and then sell it brand new. Then go buy the phone you really want (Android of course), even if it means putting in a a bit of extra cash.

Upgrade your phone's firmware and calibrate your touch screen > settings> phone> touch screen calibration (something along those lines).

I had the exact same problem with my Nokia 5800XM on original firmware, the steps above fixed it for me.

I should have said that, I am on "top up" for the next 2 years. I am requesting a other phone. But I think Nokia should be responsible for this, Vodacom are only my server provider. Well about the new phone, I got each time a new "mei" number, so I think it was a new phone.

Teraside: Yes I did all that. I have even made a backup when that didn't work. Reset my phone, but then my phone backup was not working. (phone freeze up.)

Not necesalyly, some times you get your old phone back with the Imei number chenged
 
It is impossible to change the IMEI number on any current Nokia handset!
Quick answer replacing the motherboard which obviously carries its own IMEI number.
Therefore new motherboard = new IMEI,

at the end of the day its still the same phone with 1 new part (a big part yes), not a new phone and probaly cahnging a part that wasnt broken, thats why the OP still has the same problem.
