Offer to purchase question

When I pulled out of my deal due to the report we didnt even discuss the details of it, I simply told them the report was unfavourable and I would not be proceeding with the purchase, if I recall I sent them one or two snippets with the bigger issues like the incorrect roofing issues etc. They tried to get hold of the report, to which I told them they can have it if they pay me what I paid for it.

Obviously as mentioned you wouldn't pull out using this over small issues, that should just be common sense, for bigger issues you could negotiate or have them fix it etc.
I'd have given it to them. No loss to you, big help for them...?
 
I think most properties or buildings must be 1m away from the boundary line. And in this case 1.89m away. I dont think you can relax a boundary “line”, but I could be wrong!

Our property only has a building restriction on one boundary wall and we managed to get it relaxed to build our double garage so it can be done.
 
Feel I'm now in a hurry-up and wait situation after a crazy two weeks. I'm never so sure when I need to follow up between everyone involved so tend to wait a few days before pinging lawyers.

It somehow felt more seamless 8 years ago than now.

Anyway, just looking forward to seeing some progress as we already started to window shop furniture for the new flat and we hope to get it before Christmas. We need to renovate the flat before we can move furniture in as well.

Make sure to check that all copies of the keys work on all locks. Same for gate/garage remotes. Also check that the stove, oven, lights, taps, pool pump etc are in working order. And request a copy of the electrical COC so that if there are any issues after you move in, that guy needs to come fix it.

It's easy to let the excitement distract you from checking everything...

Found some problems unfortunately. Will have to go look at everything again tomorrow. I'm exhausted now and it's been a long hectic day.

It was super shady at the time, the agent called the guy directly and asked them for it to which he replied no and then let me know. There was serious cover up of issues also, there were literally buckets in the ceiling to catch the valley overflows for example, signs of repair, pot plants covering damage, carpets covering things etc.

Other openly dodgy racist stuff going on with the deal so I wasn't exactly bending over backwards to help them

Does the pool pump fall under the electrical COC ?
 
Please let us know what the issues are.
We had a contractor in now to have a look at the house and luckily it's nothing too bad. We discovered some damp problems that we didn't know about and other stuff that we can sort out.

1. The Q that started this thread does a counter offer from the seller automatticly cancel the orginal offer?
2. How long should the offer stay open for, the agent is trying to get me to leave the offer open from today until monday night. This just feels to long and I would like to know whats going on by latest Suday night.

it's 1 day to be honest, if you want it Sunday night make it Sunday night, don't let them force you into anything unless there is sane reason such as availability of a person etc

From our experience it has to be a written counter offer. Verbal or Whatsapp leaves to many loopholes.
And then yes. The original offer lapses. Just give written notice as well that you do not accept the counter offer and would no longer like to pursue the property.

I agree but the state agent has been beyond useless. My wife has started calling her the brickwall.
She said monday but did not give a valid reason as to why. She mentioned that she does not know when she can get the seller the offer but I dont understand that. Its an email and phone call with the amount and any details.
I will go with Sunday night so I know before the wekend is over.

A side point is that I am almost sure the seller will try negotiate up so the OTP is just a starting point and a new one will have to be signed anyway.

Is the OTP signed yet? If not give the agent 24 hours to get it signed or no deal. I would guess the weekend is the time most people have to go house hunting. Agent will probably use your offer to push for a higher price from the other potential buyers.

They probably chose Monday so that they can maximize the marketing over the weekend and if that fails then only on Monday they will present the offer to the seller to sign
