Its a batchelors flat at the back of someones house. I have my own entrance and fence but the title deed only includes the physical structure not the yard itself. So what happens when I purchase sectional title on someone elses property. The link earlier (thanks) indicated we need a exclusive use agreement for commons area (my garden)
Something does not sound right here.
If have your own erf number and Title Deed then the parent property must be sub-divided into two and it sounds like this is not the case.
I don't think that this is a sectional title scheme.
It sounds more as if you are buying a right to occupy the bachelor flat and that will be contained in a Notarial Deed of Habitatio. If so, then don't pay any money to the people as this right is not transferable, you won't be able to sell that right. This right will also have a time limit.
