I don't care. I want the place. I raised the problem with her, and I just want the people out by registration.

Also, by the state of the place. COC is going to take forever. There are extension cords running out of the house powering the caravan and shacks, there are wires dangling from EVERYWHERE, etc. I don't care if it takes 6 months - but I'll be damned if the registration takes place and that house isn't empty.

EDIT: Oh yes, and I sent the agent messages stating that she must take it up with the executor NOW and she agreed. So let's see. Even if I don't get the place, that sounds like a BIG problem for whoever buys it.

This seems like a ballache of note. I hope you get sorted and that the executors and agent doesn't mess you around too much.
 
100%, it sounds like a HUGE nightmare for whoever gets the place, I hope you factored that sort of thing into the price you put in your OTP?
I did. The price I offered is just-just more than what the empty yard is worth in the area. The yards usually go for R795k, and I offered R810k. So I'm still 100% sure I'm getting my money's worth.

As a PS: You okes have no idea how "hardkoppig" and "hardegat" I am. I'll stick with something if I want it to happen for as long as it takes. I'll sue the seller for damages for years if I have to, I don't care. If he pays me rent for the place while I can't move it, that'll cover my bond. Win-win.
 
The Cape Town Deeds Office is closed because a spouse of one of the officials is Covid positive.

So they close the whole place. Crazy.

With regard to the sub tenant, ask the executor to give proper notice to all the tenants. If they give notice today then the calender month expires at the end of December.

6 weeks is wishful thinking as the Master will also have to approve the sale.

With regard to all the tenants and all the sub tenants, ask the executor to confirm to you in writing that proper notice has been served on everyone, and that the executor will confirm your being able to receive vacant occupation, prior to the date of lodgement.
 
The executor is particularly slow. I highly doubt he'll get me the writings I want.
 
My whole process is being delayed by the seller. It is a deceased estate (spouse of the seller passed away last year) so it's taking a bit longer.

The seller is delaying with the original CoC and the deed. According to the attorneys and agent, the CoC was done 2 months ago and the seller hasn't bothered to submit it to the attorneys. With regards to the deed, the property was put on the sellers name mid-October yet the attorneys still haven't received it.

Today I greased the agent a bit, saying if the property isnt registered by the last weekend of November (the day I have to vacate my current rental place) then the seller must be held liable for any temporary accommodation and moving costs. There is also a clause in my OTP stating should there be any delays in registration the guilty party pays interest at prime plus 3% , I asked the agent to invoke that clause at 10:00

I can't understand why a seller would drag their feet. I mean do they want money sooner or later?
 
We just got this estimation from the transfer attorney's. Does this all look right? I always assumed the seller paid for rates clearance & levy clearance?

I got all my clearance charges reversed, as the attorney’s said its in my benefit (as they used a runner). My reply was, it isnt in my name, so I have no rush. Please revert. Then they said I signed their terms and conditions. My reply was, legally, how can you charge me something not even on my name, as its related to the seller.

It was heated, but common sense.

They're charging for the work they do. Not your actual clearance
 
@Toxxyc you need to be careful with that situation. If the National State of Disaster is still in place by registration, you will end up paying for a bond and having no property so show for it. The courts are not giving eviction orders. Even if the SOD is lifted, eviction is a long and drawn out process.

The court will also not just kick those people out if they have nowhere to go. They'll get squatter's rights.

I would honestly advise you to rethink this.

To ask clearance figure’s on, and its in the seller’s name. And then myself (the new owner) must drive and apply. This discussion was made a few pages back. I got refunded all my charges. So I am happy

Ps, so why do we pay thousands in transferring fees again? For them to do the work.

People usually don't want to leave the premises, so they're dragging.
This, especially since this is the widow or widower who is now selling. And who might have had a heap of other issues, adminitrative and psychological, to deal with during the past year.
 
Update: FNB (own bank) came back after 1 day with 90% approval at prime minus 0.43 over 20 years. Originator is going to go back and see if they’d be willing to up the amount (maybe even by extending the term).
 
I sincerely hope I don't get stuck with a 90% bond because then I won't be able to get it.

The widow has moved out from that place many months ago and is staying with her children. The place is 100% empty, surely she would want to sell asap since she is still paying rates and levies etc.
