Offer to purchase question

Hi All

Need advice, i am in the process of buying a house and i have requested for building plans as part of the document required to finalize the purchase.

The lawyer got a runner to get a copy from the municipality or wherever the originals is stored.

However, the building that was emailed to me was very bad - you can barely see anything. I requested a better copy but they are saying that's the best they can get.

What do i do?

I would map what is visible towards to plans (and see if its on spec).

Alternatively, ask the seller if he knows of any out of spec changes ?

I am not sure i understand what you are trying to say, in terms of mapping i mean.

The seller said he has not done any major changes except for the construction of a swimming pool.

Demand a legible copy, if they can't produce an existing one they must have it redrawn and submitted

swimming pool must be on plan as well, dont believe what they say, I have a carport, lapa and extension off the kitchen that will cost me 18k to update now

you have the chance to not make the mistake many of us did. My neighbor is now sitting with a portion of their house that previous owner built right on a servitude will cost them R50k to sort out plans and might have to demolish if not approved.

Yep, when we were looking at the house we live in now, no fully approved building plans could be produced, so when we made an offer we put a clause in that we want council approved building plans that include everything.

The letter they sent to the bank for the guarantee states the 1st guarantee for the purchase price amount and then they are requesting another guarantee for the transfer fees.

My question is can they request a guarantee for the transfer fees?

You can ask the bank, to provide you a LETTER that you have the FUNDS available on request. As simple as that

You must just show or rather give a reason : that you have the FUNDS available in FULL.

The transfer fees are not part of the bond so why are they asking for that, cause then everyone should be asked for that.
But if you really want the place then i guess no harm in providing that letter.

It doesnt help you buy a R3 000 000 place cash, and ZERO money for transfer fees.

My last few boughs' was CASH, and the transfer attorney asked just proof that ALL funds all available when needed.

Its normal.

I submitted OTP and it was accepted and deposit paid.

Only the balance of the funds need to be paid.
So I am busy with a bank guarantee for the balance but the attorneys also want guarantee for the transfer fees.
 
Standard practise.

They need a guarantee that you are good for all of it otherwise every linked transaction falls apart like the seller who is likely also a buyer for another property.

Remember it’s a many months long process and if it falls flat it all starts all over again.

I signed a OTP ... and in 3 weeks registered on my name! ;)

Yes there are obviously exceptions.

But usually there’s the seller who needs to secure their new sale and then move out and wrap up etc.

Even three weeks is a long time to restart a process because guarantees fell through.

I know. My wife is selling one of her investment properties now.

Agent said in Dec. Its a clean buy. 4 months later, zero sign of lodging.
 
Hello,

Does anyone know how to request for a refund of your deposit from Eskom after you've sold a property? No responses to any of the email addresses on their support escalation page. My lawyers helped with CoJ but said they couldn't assist with Eskom.
