Just got this from in an email from Niantic on my test bot account. I'm glad they are doing this.
And I haven't used this account for over a week, so they seem to have some history on accounts too.

If it was a paid for app then sure it'd be piracy - but a freely available app - not so much.

Not to mention the T.&C. are against distributing it, so apkmania etc. would be the ones breaking the rules, not the person downloading it.
Legal loopholes are fun.
