Police confiscating a license

Hi everyone

Sadly I got pulled over and didn't even realize my personal license had expired. I'm so busy at work these kinds of things just escape me.

What concerns me is that he is taking my license.

Is there legal precedent to do so? If not I'd like to go to court, basically I don't believe he should have a document that can identify me on his person.
 
He is not allowed to confiscate. Get it returned, then lay an official complaint
 
He did issue me with a fine but then he was like "Oh yeah I'm keeping your license"
 
Officially you can pay for a temp license for a smallish fee until you get the new one issued. They normally take your old one from you when u apply for the new one.

All the info is at the traffic dep.

He also wrote on the fine that I drove without a license? Wtf. This cannot be correct. But what proof do I have?

They was another women there and they basically ignored her when she talked to them. When I talked to him he refused to quote the act in which he is prescribed to take my license. He had this sheepish look on his face when I asked him about it.

He clearly had "heard" that he could take a license but wasn't sure if he could. So he chose to go with what he wanted.

I'm studying the act now, seems they can confiscate if they believe fraud is being committed. However I think my best avenue here seems to be to lay a complaint for a disciplinary hearing.

Do that, but you still can't use an expired license to drive. It is worthless and you will have to give it in anyway. Technically you drove without a physical license, but traffic knows one was issued.

Agreed, but with police corruption at an all time high and the number of crimes being committed related to identity theft I do not believe the police should have the powers to seize at will. Not the way this guy was doing it.
 
For this reason I avoid roadblocks and if you really want to take your chances, get a dash-cam

The police officer could just as easily take a photograph of your's, and anyone else's, license. Assuming of course the details he wrote down on the summons weren't enough already.
 
Iirc you need the expired card when you apply for renewal and temporary. They stick the card to your application. Without the card you will need an affidavit and other crap. Cops details are on the fine. Lay a complaint and get it back.
 
This is simple... Your license card has expired, not your license. What you need to do, is go to the police station and have a gentle word with the station commander that you would like your license card back now, should is not be forthcoming then official complaints and such will be laid... You then pay the fine, then renew your license card
 
Also if he has fined you for driving without a license, then that is incorrect... He can only fine you for driving with an expired license card

Mr Defensive, I was confirming the idiocy of the popo man.

But hey, I don't have a lot of money to steal anyway... so he might just end up having to foot a bill or two while stealing my identity, which I guess is okay. :P
