Polygraph testing only one employee

All I ask is that you do whatever you can to the ex-employer. People should not be able to get away with things like this.

Granted you probably don't have many options but if the CCMA can do something take it seriously and teach that SOB a lesson.

If you want I know the number of some "friends" to feel his knees up... :twisted: Just kidding, but seriously whatever lawful options you have you must not just let it slide.
 
i'm also very curious about the employer. video footage should be pretty damning, so if she arrived atthe time she said she did and didn't walk out with anything she should be scott free
 
I would discuss this with the new boss asap...

Mention that once the case is thrown out (because if she didn't steal anything, there will be no video footage of it)... that she will need a bit of time off to get monies owed to her by the ex-employer because she was fired without due process etc etc...
 
I would also be investigating the option of pursuing wrongful arrest etc etc tbh...
 
Just tell the new employer that she was falsely accused of something and she now has to pursue a claim with the CCMA.

She really must do it... Its always going to be a black mark on her CV if she does not.

Once she does she can claim legal damages and her salary.
 
Malicious prosecution, that is what the op should go for. Plus, it can be easily proven once the case gets thrown out.

But yes, (if she is innocent) she must take her ex-employer to the cleaners and nail everyone involved... to attempt to destroy someone's livelihood based on an assumption is not on at all.
 
Hi Guys
My girlfriend recently started a new job at a smallish company and there has been an incident where someone broke into the place and stole money out of the safe.
Shes only been there for 2 months, still on a 3 month contract.
Police are investigating everything, but now they suspect its her because someone on the inside was involved. (They knew where the safe keys where).
I've known her for 5 years and she wont even take candy from a baby.
They told her today that she is going for a Polygraph test tomorrow, its part of the police investigation.
She is the only one going for this test, how F@"t up is that?
The thing is that there have been builders on site, with one of the ladies in charge of the builders even having a key to the place.
She is in a state and don't know what to do.
Is it even legal to only take her for the test?

That sounds dodgy. I dont think by law they can do that to her
 
UPDATE: They have the docket ready with all "evidence" needed, now we can prepare her case. Shes going to see the lawyer next week. Next court date, 1 June.

Glad the stress is finally over.

I still say that you take the previous employer to court for damage to your girlfriend's reputation, loss of income and unfair dismissal. Not to mention erroneous, backwards pseudoscientific witch trial methods to "prove" her guilt.

They are owed some comeuppance otherwise they'll simply have gotten away with it.

Please, don't let them have gotten away with treating someone like this.
