Potential RAF claim?

So last week my father was working on his car when the car engine fell on him, trapping his hand. Sadly he had to have his ring finger on his right hand amputated.

I went to visit him in hospital a few days later and when we got to him, there were 2 ambulance chasers talking to him that while he wasn't in an actual car accident he still has a case to claim from the RAF because he still pays for the license disc. They tried their best to convince him he stands a chance of getting a payout.

I don't know, that's sounds too far out for me.

These two were as stereotypical as you can get as they went bed-to-bed asking other patients of their injuries. Like they could nudge people to file a fraudulent claim
 
Not sure on the validity of this.

However, consider what it's worth to him.

My brother was in a bike accident 7 years ago - taxi hit a robot and took him out. Broke his arm quite badly, lost some degree of mobility and strength in it. More than that though, he lost his job, couldn't make payments so lost his bike, got blacklisted, couldn't easily find work etc etc.

It's now 6 years after the initial RAF claim and he is coming to JHB next week to have his day in court. Thereafter, if there's a settlement or he wins the case - another 6 months for verification and payment.

If your dad wants that fight it may be worth investigating.
 
Maybe do this on a contingency basis then nothing but time lost.
 
Doubt he can claim. You can't claim when there are no third parties involved not sure how he'd managed in a case like that.
 
Sorry to hear about your dad but if he can claim then the system is more fked than I previously believed.

maybe approaching a lawyer who specialist in such claims might make more sense?
as it might be just a rumor or could be true depending on who you ask,

id rather get a professional to advise me.

The Road Accident Fund (“Fund”) is a statutory body that, in terms of the provisions of the Road Accident Fund Act, 1996 (Act 56 of 1996), exists to provide cover to all persons within the borders of South Africa for loss or damage resulting from death or bodily injury caused by the negligent driving of motor vehicles within borders of the country.

I think you have to be on a public road when the accident occurs. Otherwise it may be a personal liability claim for your dad's household insurance?
 
I remember my grandfathers missing finger , he always did tricks with that hand , somehow made finger apear and disappear.
