Racist fund appeal dismissed

Should one be able to create bursaries for specific race groupings in South Africa?

If that fund is racist, then the BMF and the BAM are equally racist. Shocking ruling. South Africa the place where even your dying wish is no longer sacred.

With a trust it is normally a group of humans that decide what the trust does (usually lawyers). But it is always the trust that sets the rules for what can and can't be done with the trust's money. The humans must act within those rules. Now it seems the trust just sort of sets the rules until a court decides otherwise. Which is scary.
 
Surely then the trust must also be opened up to men too? Isn't limiting it just to women sexist? Or are they saying it's ok to discriminate on gender but not on race? In fact where do you draw the line? Surely to be truly free of discrimination this fund should be open to all sexes, all races and all nationalities too?
 
I cannot believe it.

This was someone's private money and in the will it clearly stipulated what his wishes for the money were. We have no right to change that.

This is going to have serious implications for people deciding whether or not to leave their money to a university now. I wouldn't give my money to a university knowing it can change the conditions I wanted.
Happened already. The Rhodes scholarship used to be for men only (Rhodes was a homosexual), it was eventually expanded to include woman.

Nothing is sacred for the ANC when money (gravy) are involved.

There has actually been cases where the white guy won race claims. I remember one a while ago about a doctor that was laid off to be replaced by a black doctor. He took them to court and they had to rehire him and payback his salary because this was done randomly and not because of an official BEE or transformation thing. That being said, this is a bunch of crap, he gave his money with clear instructions, its not for the state to intervene. The up side to this is that it should give legal president for any cases where whites were rejected because applicants have to be black.
 
The SCA must obviously be a bunch of politically-correct plodders to make a ruling like this. They obviously think it construes as 'unfair discrimination', which is not really the case here, is it? Isn't more of a case of targeting a specific group of people rather than excluding other people? I don't know, I'm no legal eagle.
 
I hope that whoever was defending the case now makes a complaint at the constitutional court because the person who gave this money's constitutional writes were ass-raped.

Only when viewed from the one side of the fence and not the other side. There are many current bursaries that exclude other race groups directly. So what was the issue then? The particular race group falls in the so called "previously advantaged" category.

I really hope that these curators now revoke the fund forever. If you donate funds for a reason, that reason should be upheld.

+1 to the Ops original question, does this mean racially restrictive requirements must be dropped on all funds? Where does that leave BEE and AA and the rest of the gravy train?
 
Can you name any started by inviduals and not companies wanting a cop out on their BEE credentials?
