Gym rape suspect cleared

Durban - New evidence of an existing relationship and CCTV footage that undercut allegations of a "rape" at a popular gym have seen the case thrown out of court.

A man accused of raping a 15-year-old girl at Westville Virgin Active will not face prosecution, after the National Prosecuting Authority examined the docket.

The gym is popular with Westville school pupils, and is set in one of the city’s most sought-after *suburbs.

No sign of duress

The footage, captured by a network of cameras inside the gym, is understood to have caught the two exchanging conversation and shows their walk into a bathroom, with no sign of duress from the girl.

Evidence from the victim’s circle of friends also indicates that she and her alleged attacker had been in a relationship, and medical evidence suggests that no act of sex had taken place.

The alleged rapist, who was identified by gym management and police almost immediately after the incident, was extensively questioned by police and was released.

Police spokesperson Sergeant Stephen Clark confirmed that the senior public prosecutor had reviewed the investigation docket and returned it with a note indicating that there would be no prosecution.

I can only imagine that this whole allegation was down to the folks finally finding out about this relationship.

Me thinks that Virgin Active will now offer an extended club-memberhsip to the accused for the expelling him in the first place...
 
They should give these girls a few years worth of community service.

Unlikely, even though the case was thrown out, what and where they did it was still against the Gym’s rules.

+1, the boy/girl who cried rape. Either it's stupid children lying to their parents when confronted about their relationship with an "undesirable" person (i.e. older, problem kids, religious/cultural differences etc.), or it's the parents who refuse to believe the relationship choices of the children, forcing them to cry rape to hide the truth.

Not to mention the lasting impact being falsely accused of rape can have on a person which can be severe.

Granted a life ban is a bit harsh, but granting him a honorary membership, as to which I was responding to.

It actually makes the initial rape claim even worse in my opinion...

Can you imagine being the guy... go into the toilet to have a "chat" or maybe get a bit of nookie (but no sex) and then get a rape claim thrown at you.... can only imagine the :wtf: moment going on in his head.

Maybe she cried rape because he didn't want to have sex with her. Women can be so diabolical. And that said, she is not yet a fully-fledged woman so she probably didn't think this one through.

Regardless of her reasoning behind it (or lack thereof)... We really need some kind of cry-wolf punishment in this country...

She started down a path that could have absolutely destroyed this mans life..... and she will now get away without any sort of censure, I find that unacceptable.
