Rape at Virgin Active / Westville

Regardless of her reasoning behind it (or lack thereof)... We really need some kind of cry-wolf punishment in this country...

She started down a path that could have absolutely destroyed this mans life..... and she will now get away without any sort of censure, I find that unacceptable.

No no, I was by no means making excuses for her behaviour; was just trying to get to a reason for why she did what she did.

I'm totally with you on the contention that she should be punished. Hopefully the boyfriend dumped her too; that should be enough emotional anguish already.

Pretty sure the boyfriend has dumped her... but I wouldn't even begin to classify that as enough emotional anguish..not for the amount of potential harm she could have caused in his life if this had gone anywhere in terms of the rape charge.

Fortunately there is a standard battery of tests before such a charge even gets to court, think physical tests, DNA tests and the rest. That's why I said that she didn't think it through, especially considering that there was no physical act.
 
It actually makes the initial rape claim even worse in my opinion...

Can you imagine being the guy... go into the toilet to have a "chat" or maybe get a bit of nookie (but no sex) and then get a rape claim thrown at you.... can only imagine the :wtf: moment going on in his head.

No, it does not - the guy being 25 years old had a relationship with a minor and if there was sexual intercourse he would be charged with statutory rape. There is a difference between having sex with a woman and finding out later that she is a minor or like in this case, the guy having a relationship with the child. In his case I doubt that he can plead ignorance on not knowing that she was a minor.

I think Virgin Active reacted wrong in the first place (go back and check media coverage and their FB page), but after all the guy caused himself all the problem. How many stand-up guys would have a relationship with a 15 year old (hell, most of the women above legal age in the gym are cooked one way or another)
 
We're assuming he was 25 though, i don't recall seeing his name or anything concrete in any articles regarding his age (I may have missed it though).
 
NPA dismisses Westville gym rape rumour

A 15-year old girl alleges a man forced himself on her in the bathroom of the gym.

CCTV footage later surfaced allegedly contradicting her claim.

The NPA's Nathi Mncube says the director of public prosecutions is yet to make a decision on the matter.
