i have spoken to my service provider and they actually have recordings

I think you'll find they meant records of your calls - not recordings of them.
 
You can get the records without a court order as they must be able to show them in order to charge you. You'll likely have to pay a fee.
 
It is illegal in south africa to record a telephone conversation without informing participants of said conversation of the recording,except ofcourse by law enforcement in criminal investigations.

There's no way Cellc or any network has voice recordings of your conversation.

If you recorded the conversation yourself but didn't inform the other person that the conversation is being recorded... It would not be admissible as evidence in court.
