Yet, there are strong talk of trying to change Section 49 of the Criminal Procedure Act, which deals with the powers of using a firearm for arresting purposes. Some years ago the use of firearms during the arrest procedure and the use of deadly force were curbed to basically self-defence and now there are voices, and it seems the Commissioner is in the forefront, are trying to change that Act again in favour of something close to what it originally was, as it is now claimed that the hands of the Police are tied, because it basically means that once a crime has been committed, armed force cannot be use in an arrest if the criminal tries to escape, unless the SAPS members life is in danger. Since the criminal is fleeing it could at times be difficult to proof that you had to use deadly force in order to save your own life? This would then not really support the quoted piece, or is it again a case of lip-service and/or the left hand is not knowing what the right hand is doing?
