Robbery accused Bongani Moyo, who escaped from custody in August by walking out of a Pretoria court, urged a magistrate on Tuesday to have his shackles removed.

He made the request when he and three co-accused appeared in the Pretoria Magistrates' Court on Tuesday. Moyo appeared in court via a video link from Pretoria Central Prison.

Moyo and his co-accused, Leon Ncube, Khumbulani Sibanda and Thabani Sibanda, face several charges of armed robbery.

When Magistrate Maryke de la Rey said the four would remain in custody until December 13, Moyo raised his hand to get her attention.

“I have a request. I am staying in shackles every time. Is there anything you can do (about the shackles)?”

De la Rey instructed Moyo's lawyer from the Legal Aid Board to discuss the issue with prison officials.

She assured Moyo that his lawyer would ask that the shackles be removed.

They were introduced at the request of prosecutor, Werner Gibson after Moyo made headlines when he escaped from the same court.

He was using crutches when he was brought to court by prison officials on August 10. He escaped by nonchalantly walking out of the court buildings along with members of the public.

Moyo was arrested three weeks later.

It was not the Zimbabwean's first escape attempt. In March, Moyo escaped from Boksburg prison. He was arrested almost three months later.

Moyo is accused of involvement in more than 35 bank robberies and other robberies.

He is to stand trial in November for the court escape.

Shackle the bastard to his shackles, then shackle him to the furniture and shackle the furniture to the wall.

Is he for real ?

shackles really should only be used in the courts where a reasonable fear of the accused (or witness) will cause a disruption to proceedings or pose a threat to the court or the public and that shackles would mitigate the threat; they should not be used as a form of "punishment" for making the police or security look stupid. If the guy managed to walk out of the court with a member of the public it just shows him to be resourceful and the people guarding him have been negligent. I've been at a magistrates office where you have unaccompanied accused persons walking about with leg iron shackles amongst the general public that is a far bigger threat than having an accompanied armed robber not having shackles on. Also as is stated in the article the accused in this case as in a prison during the hearing - they audio linked him for a postponement hearing so having shackles on is unnecessary - he is locked up already - and diminishes from the dignity of the court process (which is already slightly short-changed by the AV process). The magistrate is therefore quite frankly spot on, he didn't make sweeping rulings outside the scope of things but directed the accused's legal representatives to pursue the best interests of the accused.

Who gives a crap? He's a proven criminal. He should not have ANY rights.

Exactly. If he escaped, whether it be from pure negligence from the authorities or a well crafted escape plan, he's a risk....
+10000, its a shame that a lot of people out there will defend criminals like these. Why should I care about his human rights if he doesn't respect my rights or anybody elses. Only victims of crime will understand.

Remove the shackles and then shoot him in the kneecaps. Risk removed. A fair compromise?
 
keeping the assumption that the man is guilty of that which he is charged with lets apply the logic fully: if you are a criminal (so do we apply this designation only to what in English nomenclature is felonies or do we extend it to misdemenors) you should be shackled in court because the government is too lazy and incompetent to prevent people from willy nilly walking out of court buildings?

O and while you are in prison you should be shackled too - because BTW the guy was in a prison AV room shackled. It is the prison authorities stupidity not the fact that the man is a criminal (and I assume that he is one) that is the reason for his being shackled and that is the problem.

Shackles is one way of keeping him from walking away. So you want to take away one of the government's tools to keep him in custody, and then blame the government for being lazy and incompetent?
