Our company held a meeting with our team where 2 of us are being made redundant.

We are the only 2 people in the company that has been given letters. The company size is over a 1000 people.

From a legal perspective is this normal ?

If they followed the rules for rentrechment then it's likely legal. You can question it and have a professional look into it if you find it dodgy.

They following the whole 3 month process starting today

Retrenchment doesn't necessarily have to affect a whole lot of people, although it is odd that only two people are affected in a company of that size, are you sure there aren't others from other departments?

Not that we know off as yet, I have heard rumours that some permanent people are being worked out

However with the 2 of us they have started the process

Sorry to hear. I have seen it at my company at least twice. Our division of the bank at the time was about 700 people. 2 Teams where made redundant. First case 27 jobs became 14 with all 27 able to apply for the 14 positions. The other time it was a team of 3 people that where all redundant and they where retrenched. One found work elsewhere in the same group company, the other two left. Was definitely done legally here but is obviously unpleasant and sad. The time with the 27 was done legally but handled poorly. They made the announcement mid December right before Christmas which was a bit of a jerk move most felt. People where cutting holidays short to apply for jobs and stuff. The one guy applied for a job in my team and got it and despite them knowing he got it they did not bother to tell him for 3 weeks, so he got another much better offer kind of going and was only with us 2 months before that one panned out. Was a big loss that would have not happened had HR just done their job right.

Yeah its a tough time to go through something like this

My colleague and I are very skilled and can do the job most other depts. cant so its weird that we not being offered other roles

Might be the reason why in terms of skill == high(est) remuneration, if that's the case. Something to think about.

Good luck to you and your friend.

I chose to resign.
Got a better place. Living surrounded by nature. See more people in a day than I did a whole week.

Now I'm smoking a bit of green and working on my own goals.

That's awesome hopefully you are also in a better place mentally, remember you would often tell of your battles with depression. Good to see your happier.

Thanks Matt.
It's still a bit new to me, but I'll get there.
It's definitely less stressful.

Just a reminder

Retrenchment is the last option usually after all other avenues have been considered.
The onus is on the company to prove that.

Be aware of constructive dismissal - that is, being dismissed for a reason that is not strictly true.

Retrenchment is usually based on operational reasons, which is quite easy to justify considering the current COVID circumstances. You have the right to consult with the employer and ask for such financial evidence.

Sometimes, its better to walk away than to fight, depending on the employment atmosphere.

Good luck. :(

thanks bud

so can you ask for financial proof as they saying its budget cuts ?

But we the only 2 in the organisation that we know off and its not performance based.

The company doesn't employ perm people in a hurry as they get lower skilled to do the higher paid work with lesser pay than a perm guy who would ask for more money

If you are being retrenched for operational reasons - and that reason is stated as being financial, then yes.

From now onwards you must not take any leave. Let the company pay you out for it. They should allow you reasonable time off to go for interviews without your having to take leave.

I remember there was a guy that was trying to use mybroadband to be his whole company's HR department... ah, good times - before Covid.
I'm too lazy now to search for It.
That was old school spamming though :p
