"We are not intimidated by the AWB. We are not threatened by them and they have not threatened us." However, taking into account the boy's background, his age, what social workers said, and his reluctance to reveal his defence at a bail hearing, he decided not to apply for bail.
"My client is happy where he is. He sleeps in a bed, he watches television and he eats. It's something he never had before."

Earlier Majavu said that the boy was sleeping in a bed for the first time in his life.

News24 article quoting the lawyer for the boy accused of murdering ET.

I am also in a prison where I can sleep on a bed, watch television and eat food. Only difference is I have to pay for it myself, while the criminals get it for free.

What an incentive to murder rape steal.

I dont think you understand the lawyer's point in the article. He is trying to paint a picture of a kid that has had it SO difficult in life, that he prefers to stay in prison...

That is exactly how I understand it - for him and I suppose for many others in this country, it is better to be in prison than outside. The threat of going to prison does not carry much weight. In fact it is a reward.

Question i have is why are the basic rights of the children not been adhered to and enforced?

28. Children

1. Every child has the right *
1. to a name and a nationality from birth;
2. to family care or parental care, or to appropriate alternative care when removed from the family environment;
3. to basic nutrition, shelter, basic health care services and social services;
4. to be protected from maltreatment, neglect, abuse or degradation;
5. to be protected from exploitative labour practices;
6. not to be required or permitted to perform work or provide services that *
1. are inappropriate for a person of that child's age; or
2. place at risk the child's well-being, education, physical or mental health or spiritual, moral or social development;
7. not to be detained except as a measure of last resort, in which case, in addition to the rights a child enjoys under sections 12 and 35, the child may be detained only for the shortest appropriate period of time, and has the right to be *
1. kept separately from detained persons over the age of 18 years; and
2. treated in a manner, and kept in conditions, that take account of the child's age;
8. to have a legal practitioner assigned to the child by the state, and at state expense, in civil proceedings affecting the child, if substantial injustice would otherwise result; and
9.

not to be used directly in armed conflict, and to be protected in times of armed conflict.
2.

A child's best interests are of paramount importance in every matter concerning the child.
3.

In this section "child" means a person under the age of 18 years.

Right.. do you really think this? Having no freedom, crammed into a overcrowded cell, probably being beaten up or raped by gangs? Life in prison is terrible for anyone, especially in South Africa.

I never understand why some people (invariably those who are never going to go to prison or probably even seen the inside of one) think prison life is aspired too, or even a reward.

So why aren't you murdering, raping and stealing? White morals getting in the way?

Do you also get uninvited manlove?

Ha, publicity stunt to make out that ET was abusive towards his workers. I don't believe that there was no beds for workers on the farm, or that they where not eating. There may not have been TV, but that doesn't mean abusive work conditions. Quite clever lawyering there.

Going to be a bit of a flop considering that ET wasn't living the high life anyway.
