You must have been dealing with a loon - a bike loses to a car everytime.

True, but it was a Harley though. You're going to end up with significant damage to your car. Might just be worth it though :twisted:
 
'Crimen injuria' basically means he used a racial slur against you.

I really wouldn't worry about that, though. Report the case to the cops as malicious damage to property. Then turn it over to your insurers. Make it clear that all damages - including the excess - are for the account of the person who caused the damage. If they refuse to follow up, take it up with the insurance ombudsman.

Or, you know. Accept that you live in a violent society, blah blah, and can't change anything. Sit on yo ass and cough up all the dough yourself.

It's your choice.

At the absolute least find someone who can get you a postal address for the idiot. Send him unmarked letters telling him how you feel about his cowardly ways... tell him you will be watching his every move.... basically pull a "psycho" on him. ;) Might not achieve much but could make you feel better and make him think twice before doing something like that again.

Only way to achieve anything would be a court case. And before going that route you'd have to make sure that you can make the charges stick. For that you would need some sort of proof, which you don't have by the sound of it. Like security cam footage or a witness.

Police can't do anything either without proof.

Totally unfair, but to be honest I don't think this is going anywhere.

You can report him to the arrive alive campaign thing maybe. Little consolation, I know.

You know he could have had a witness with him - in that car. The idiot with the attitude would not remember, after all, he was enraged.
 
The problem is that if you did that YOU would be the one going to jail, not the guy you killed.

I agree with Grayston. You being the only witness does not necessarily mean you have NO case. How many murders have no witnesses, how many rapes? Lay a charge! He can be convicted by your testimony alone, remember in our country, even circumstantial evidence can get a conviction (at least theoretically).

@ the other guy with the Harley... I am sorry to say this, but in my opinion you are not a victim, you followed him 1st and tried to shout at him, what he does after that is merely a result of your aggression. Not attacking you, just an opinion.

Also to the OP, next time don't hoot at someone, thats your anger acting out. Rather just let him be, you wouldnt have been in this position in the 1st place. I understand he did wrong and you were angry, but thanks to Taxi's and the like we have alot of people with road rage.

I had a similiar experience recently...

It was about 7pm (getting dark), and I was pulling up to a 3-way stop. I saw some guy approaching from the opposite direction on a Harley. I could see that he wasn't go to stop, and he didn't - he flew threw easily in excess of 100 km/h.

I hooted and then proceeded to follow him. He turned into my suburb. I followed up him up the entrance of a complex, leaned down my window and let rip about not stopping, querying him about wtF he got his license, etc.

Barely two sentences in this c*nt starts his bike and now starts chasing ME!

He's alongside me, threw blind corners, in the oncoming lane. We're hurtling through the suburb, and eventually open up onto this straight. Now he's alongside me (window open), and the next thing I know there's an almighty clunk on my car. I slam on anchors fully expecting him to come over the roof. Looking in the mirror I can see a helmet rolling around in the road, so I know now what's he thrown at me. I angle the car and lean out the window yelling at the @#$^er for throwing something at my car, etc. The helmet's still rolling around on the road, and he's striding towards me trying to look macho, all the while hurling verbal abuse at me and threatening me. The next I know he's got his grubby paws in my window.

I didn't stick around to see if he had a blade or a piece - I put foot and left the A'hole in a cloud of tyre smoke, heading for the cop shop. He was a good 20m from his bike and didn't - or couldn't - follow me.

I pulled into the cop shop parking lot and checked out my car in detail. Finding no damage I debated reporting the incident.

Assuming future intimidation, I left it and went Home. The car actually belongs to my folks, so I was obliged to tell them what happened. So far we haven't seen or heard of anything in 2 weeks, so we're chilling now.

...before you ask, I didn't report it because I knew we would then definately get sh*t from one or more angles, and because the last person I trust in ZA is a copper.

In this country colour takes precedence over everything and say what you want, but I don't Trust reporting assault from a black dude to a black cop. End of story.

If some c*nt pulls a stunt like that with me again, he better hope I'm in a car that can be IDed because I'll run the bastard over.

No matter who was in the wrong or not, if you going to lash out at someone & swear etc for whatever it is, just make sure you can handle yourself. I think you were VERY lucky that he never caught you, cos it sounded like you SHAT yourself. Next time you might not be so lucky.

I had an run in with an inconsiderate ******* who was riding a bicycle & he decided to swear & zap me for something that was his fault. On chasing him & questioning him about what happened he got all worked up & tried pushing me. A second after he pushed be, he was laying next to his bicycle all nice & injured with 2 buckled rims.

I'm very apologetic if I have done something wrong but don't attack someone when you are in the wrong. I got myself something I call " Maximus " which now lies under my seat, just in case of a road rage moron.
 
Dude laying charges is going to get you nowhere, your word against his. You can be very lucky you did not get beaten though, heard some horror stories in regards to this topic :eek:

Report and claim from your insurance and give them his number plate.

My leave it alone. You have no witness. Sounds like a crazy guy who could easily have given you a life threatening beating, just let it go as hard as that is to do rather just leave it.

How many cases amount to "your word against his"? This is no reason not to pursue a case.
 
Report it at the police station - tell them you are laying charge of crimenia injuria and malicious damage to property. You don't have to give a rat's ass about whether the charges stick or not. That's for the courts to deal with.

And why ask the cops for advice - lay the charge. The lazy plods will tell you not to bother. Tell them that you are laying the charges and that you want a case number. And when you have that number you can call them every day to get a progress report.

If nothing else they will have to track down the other guy and get a statement.

Whether you are biased or not is irrelevant. That's the court's job.

Go for it.

If you're going all out, you could add a charge of assault. The definition of assault is wide enough to cover cases of threatening behaviour too.

Maximus? Why do I get the image of a giant gold-colored rubber dildo? :D Mind you, if climb out of your car waving something like that around it would probably really freak out your opponent. Plus, it could probably double as a baton in a pinch. ;)

I could have pulled out at the stop street but then I would have a ding in my car from that A'hole. He knew he was in the wrong, and yet he still decided to brush me off with a FY attitude.

Do you honestly believe it's right that someone scolding you for doing the wrong thing deserves to be assaulted?

If you're acting like an A'hole and/or endangering my life and my property I'm going to tell you exactly that.

This is an oft-repeated myth, but it's not how SAn law works; as long as it's justifiable self-defence (and you don't use a random crappy lawyer), you will be OK. If i was carrying (already have a firearm license application underway, incidentally), given the nature of the attack a response would likely have been justifiable, however I would not have used the gun anyway unless it literally came to blows as I don't have the time to deal with the fallout of something like that.

Likewise, which is also one of the reasons I've hesitated on reporting it so far, as I've had and seen bad experiences before at the station with jurisdiction since they kicked the white cops out of it, and the attitude of the cop when I went in (questioning me as though I was the perpetrator) just re-confirmed those fears; these guys are having a fine time just harassing any white person who comes through the doors.
