oth recommendations made by ActionSA in exchange for its support for the fiscal framework of the budget appear to already be off the table.

Finance Minister Enoch Godongwana, in a responding statement in the DA's court case against the upcoming increase in VAT, said that the 50-basis point increase will take effect on 1 May, as he announced in his budget speech.


He argues that the increase cannot be reversed because retailers and wholesalers have already adjusted their prices accordingly.


Godongwana's affidavit, which was submitted on Thursday, states:

Since its announcement, the decision has been widely communicated across the country, and businesses and consumers alike have relied on it in planning for the financial year ahead. The VAT rate is therefore set to increase to 15.5% on 1 May.
Moreover, this past week, Godongwana, in response to a parliamentary question from DA MP Wendy Alexander, confirmed that there was no adjustment to the personal income tax tables for the 2025/26 financial year, adding that this amounted to a tax increase for South Africans.

ActionSA, along with other smaller parties and the ANC, helped get the fiscal framework of the budget approved earlier this month. According to the framework, VAT will increase by 50 basis points this year and by a further 50 basis points next year.


However, ActionSA's support was based on a recommendation that Treasury should look for alternative sources for the R18.5 billion that would be collected if personal income tax brackets were not adjusted for inflation, as well as for the planned R13.5 billion that the VAT increase would bring into the state coffers.

These recommendations were not binding, despite ActionSA initially announcing that it had made an amendment to the fiscal framework.

From Godongwana's court documents, it now also appears that there was never a plan to revoke the VAT increase. In response to an allegation by the EFF, which, together with the DA, has gone to the courts to stop the VAT increase, Godongwana explicitly stated that there was never such a plan.

Godongwana said:

From the outset of my announcement, the National Treasury, the SA Revenue Service (Sars) and I have consistently and publicly stated that the VAT rate will increase to 15.5% on 1 May 2025. This remains my position.
"[For the] VAT increase [to be suspended], either another tax measure would have to be implemented or government spending would have to be reduced."

Godongwana also told eNCA on Wednesday at a presidential imbizo in Gqeberha that he saw no alternatives to the VAT increase. "If I had alternatives to the 0.5%, I would have questioned my fiscal framework. I would not have proposed the fiscal framework if I had alternatives."

He admitted to Newzroom Afrika that various parties had made proposals to him about where the alternative income could come from, but emphasised that the onus was on Parliament to reverse the VAT increase.

City Press' sister publication Rapport learnt from ANC sources that, following Godongwana's comments, ActionSA had requested an urgent meeting with the ANC.

Mmusi Maimane, leader of Bosa, which also supported the fiscal framework, told News24 he was still trying to determine whether the fiscal framework, which had already been approved, could be withdrawn or amended.


The ANC denies that it deceived ActionSA and Bosa. According to the ANC, their proposals were handed over to Treasury.

The publication reported last week that ActionSA had proposed a timeline to the ANC to reverse the VAT increase in record time.

According to the VAT Act, VAT is automatically increased when the minister of finance announces it. The only way to stop the increase is to pass a new bill.
According to sources in Treasury, the bill would include the VAT increase, but ActionSA insisted that this bill would be reversed by a new amendment bill that the party wanted to pass through Parliament within eight days.

The DA's court case will be heard on Tuesday.

DA leader and Agriculture Minister John Steenhuisen and his party want to have the VAT Act declared unconstitutional. The DA also wants to get an interdict against Sars' implementation of the VAT increase because the party believes the correct parliamentary procedures were not followed with the adoption of the fiscal framework.
