A 50-year-old Mpumalanga border officer who raped a 13-year-old girl was handed a suspended sentence in the Boschfontein Regional Court on Wednesday.

Magistrate Edgar Moletsane sentenced Dalton Zulu Nyambi, a senior SA Revenue Service inspector, to six years' imprisonment, which was suspended for five years, a Sapa correspondent reported.

"I find you guilty as charged for having sex with a minor. If you commit a similar crime within a period of your suspended sentence, it means that you will be locked up," Moletsane said.

Nyambi had pleaded guilty to having sex with the 13-year-old girl during a drinking spree on September 10, 2013. He was arrested on December 3 that year.

And how does Magistrate Edgar justify this complete sham of a sentence?
 
Hang on, is this rape or statutory rape?
 
was it rape or was it classified as rape cause she was a minor?
 
Justice once again a joke in this country

If there was any justice in this country Shabir Shaik would still be in prison and JZ would be in the same cell as a result of his own 783 charges; not to mention many more resulting from the enrichment of himself and his circle of connections.

If this is one of those cases where it was consensual and the girl in question didn't actually file the charges then I can somewhat go with it.

Need more details to understand the judgement better.

He did also plead guilty, so it's not like he was trying to get away with it. Either way his life will be a suffering with that criminal record.
 
She consented, i.e. He made sure he gave her enough alcohol so that she couldn't say no.
 
ANCWL URGES NPA TO APPEAL MPUMA RAPE CASE

The African National Congress Women's League (ANCWL) called on the National Prosecuting Authority on Friday to appeal the suspended sentence imposed on a border officer found guilty of rape in Mpumalanga.

"The ANCWL is calling on the National Prosecuting Authority to appeal the suspended sentence and ensure that justice is served, especially to safeguard our children," it said in a statement.

Dalton Zulu Nyambi, 50, who pleaded guilty to raping the 13-year-old during a drinking spree in September 10, 2013, was handed a six-year suspended sentence by the Boschfontein Regional Court on Wednesday.

"This essentially means if he does not commit any criminal act for the next five years he will see no jail time for his deplorable actions," the ANCWL said.

Its president Angie Motshekga said on Friday that the case was a "travesty of justice".

"This is a case where an older man manipulated a young girl, fed her alcohol illegally and took advantage of her," said Motshekga.

"According to our law, this is the rape of a child and the perverted old man should go to jail. It is disgusting and shocking that he can get away with this."

The age of sexual consent in South Africa is 16.

The ANCWL said it was concerned about recent incidents "where the justice system appears to be failing our women and children in some cases".

I am open to correction but I don't recall a storm of complaints from the ANCWL about ukuthwala which is simply part of their sacrosanct culture but, all over the civilized world, is seen as kidnapping and rape.
