Respect to the man that came out and reported the 2nd assault although he refuses to open a case for fear of intimidation

I wonder why Shaik is such an aggressive person. Assaulting people left, right and centre .... and these are strangers! I can just imagine his behaviour at home.
 
The doctors that lied and said he is terminal should have their licences revoked also! Agents...ALL OF THEM!

I had some thoughts on this as well - do we know who they are? You know, just in case I need a [-]get-out-of-jail-free card[/-] doctors note?

But seriously though....I am personally offended by these fcking doctors. The reason is because my dad was a doctor and medicine is one of the proffesions where the highest standard of ethics must be applied. But I guess a lekker big sappige cash cheque is just too tempting for many many people. Fck the Hippocratic Oath and all that jazz.

I doubt he will stay in jail. I think this is just PR work going on for the DCS.

I'm suspicious also....normal working of the law; charge or report laid with Saps, suspect picked up for questioning; docket prepared by investigating officer; goes to prosceutor, who decides court hearing or dismissal, based on evidence!
Bail or trial by district court, where offense took place or case thrown out if evidence not forth coming! Not usual for Dept of Corr to make arrests! Unless I'm missing something! Long since I've been arrested!

This article from the M&G makes the situation much clearer in terms of the legal process being followed by the DCS:

Fraud convict Schabir Shaik has been re-incarcerated at the Durban Westville prison for 72-hours after possibly violating his parole conditions, the department of correctional services said on Monday.

Sonwabo Mbananga, spokesperson for Minister of Correctional Services Nosiviwe Mapisa-Nqakula, confirmed this to the Mail & Guardian, saying it was not an arrest but a re-incarceration.

"He was re-incarcerated this morning and has been kept at the Durban Westville prison," said Mbananga.

He said Shaik would be behind bars for 72 hours, which is "permissible in terms of the Correctional Services Act", and during this time an investigation would be conducted into allegations of assault against Shaik.

He said that if Shaik is found guilty of the alleged assault then he would be in violation of his parole.

Mbananga said he hoped the investigation would be concluded within 72-hours, so that recommendations can be sent to the parole board, which will decide on what action should be taken against Shaik.

"If found guilty, the parole board will decide whether to amend his parole conditions or to cancel his parole."

Medical parole
The Sunday Times reported that Shaik hit a man, Mohamed Ismail, outside a mosque in Durban on Friday. He had apparently parked in the man, who was trying to get to his daughter in hospital.

The police are already investigating Shaik for allegedly choking and slapping a Sunday Tribune reporter on a golf course about two weeks ago.

In 2005 Shaik was convicted of fraud and corruption and sent to jail for 15 years. The current president, Jacob Zuma, at the time was axed as deputy president following Shaik's conviction. Shaik was Zuma's financial adviser.

Shaik served only two years and four months of his 15-year term. He was released on medical parole shortly before Zuma became president.

'Decisive action'
Meanwhile, opposition political parties on Monday welcomed the re-incarceration of fraud convict Schabir Shaik.

The Democratic Alliance (DA) said the party was pleased the correctional services department was taking the matter seriously.

"These two incidents [allegations of assault] indicate that Mr Shaik is incapable of staying within the parameters of his parole conditions, and clearly does not appear to be suffering from the terminal illness that was the basis for his medical parole.

"We urge the [parole] board to take decisive action against Mr Shaik if its investigation finds him in violation of his parole. Failure to do so will cast serious doubts on the credibility of the board, the parole process, and the department of correctional services," the DA said in a statement.

The Freedom Front Plus said Shaik's behaviour showed he was not terminally ill and that he must go back to jail to complete his sentence.

Party spokesperson Pieter Groenewald said Shaik was an embarrassment to correctional services.

"It is high time that action is taken against Shaik ... his arrogant actions show that he thinks he is above the law."

Independent Democrats secretary general Haniff Hoosen said: "Clearly this is the end of the road for a man who has conducted himself as an 'untouchable' and has managed to dupe the government into believing that he was gravely ill."

Meanwhile, the South African Policing Union (Sapu) commended the department of correctional services for its action against Shaik.

"This swift action will go a long way in terms of bringing some credibility to our criminal justice system and constitutional order," Sapu secretary general Oscar Skommere said in a statement.

If Shaik was not on parole and assaulted someone would that be ok?

Why not do the same as what they did to Al Capone, the authorities could not get Al Capone for Prohibition Violations so they nabbed him on tax evasion grounds. The same must be done to Shaik, if you cannot get him on Parole Violations then get him for assault.

He is currently in jail because of violating his parole conditions. Should the victims want to lay charges against him for assault, they are free to do so.

Am I understanding the message in that correctly? If so I am sorry Dix.

The way I read it, her grandpa would pay her R2 to stop asking questions or be more quiet around the house etc. when she was a Dixiekidlet. Maybe I'm misinterpreting it.

Hang on - I thought that Correctional Services had said that the assaults had nothing to do with his parole conditions. And then they said that he had been taken back into custody because they couldn't have a violent person out on parole.

I suppose they thought he was too sick to swing a fist. Perhaps they should have realised that he wasn't too sick to swing a golf club.

Well, the way things have gone so far there is a slim chance of them finding him guilty of violating his parole or going back to jail so the next best bet would to get him on assault charges.

She did not say WHAT she had to shut up about. I am sure Dixie phrased it ambiguously on purpose. If she wanted to give details, she probably would have done so :)

That does not sound right to me ... all a bit confusing.

How can an alleged assault have nothing to do with parole conditions? The commission of any crime is an automatic violation of parole.

However, the flipside of the coin is that the assault has not been proved in a court. It is mere allegations.

If the DCS is not interested in the assault, how can they refer to him as a violent person ?
