Technicality. Most of the Travelgate scum of the earth for instance are not going to be formally charged in a court of law.

Perhaps a legal beagle can help with this question.
There is some law or guideline that applies to MP's and government officials whereby even if they are convicted, if the sentence metered out is less than X, they get to keep their jobs.
I cant remember the detail, anyone?

But isn't one of Shaik's companies actually involved with the credit card licenses for the government?

Yup and it is coming under review for that very reason. Needed a few prods though, but being reviewed nonetheless :)

Prodiba, which is partly owned by Schabir Shaik, the convicted Durban businessman, has been producing credit-cards drivers licences since 1998.
