Smoking times...

Hey folks.

Just for interest sake. What does the labour law say regarding smoking times in the work place? Length of breaks, amount of breaks allowed?

Can't exactly google for it now :p

yeah im also interested.if i took as many breaks as my colleagues take smoke breaks id have ALOT more time off. this one guy has about 3-4 10 minute smoke breaks a morning :eek:
 
I don't think it is a labour law issue but how individual companies view the loss of productivity.

The labour law specifies the minimum breaks required and does not specify smoke breaks. The same way it does not legislate water cooler and coffee breaks.
 
SA Labour Law does not make any provision for smoke breaks. The management should take the matter up with the "rookers" and tell them to stop. Alternatively you could raise a grievance, and management would be obliged to resolve it. The simplest way would be to rule that smokers only smoke during their tea / lunch breaks, and at no other time - they are empowered to insist on this in terms of the Act.

lol easier said then done....they find out you laid the greivance and you get a huge X on your back in return.its all good - he's the one killing himself quicker not me :rolleyes:

Thanks. Actually asking because I smoke myself. We've got many breaks and it's great, so I was just wondering how it all worked. :)
 
Well if your employer is not totally anally retentive then it is usually a casual agreement, but you do get those retarded ones occasionally.I would seek other employement if that was the case with my work.

Luckily my employer is very lenient with regards to breaks, thank god.

Yeah, mine too is linient, smoke whenever i feel like it :)

Bad though cause i smoke too much :(

Sure but he is also raising your medical aid cost if your company has a group medical aid. In the USA some companies are firing people who smoke because of this.
 
My mates company just got smoking times. You only allowed to have 3 smoke breaks a day! that is complete BS imo.

I can smoke whenever i want but my company just introduced the new smoking laws - Cant smoke near any entrance, cant smoke in enclosed areas. So now we gotta trek down to the car park to smoke.

How many loo breaks do you get a day?
 
My wife's old company didn't mind how often smokers went out to smoke. Thing was, they had to clock out to go out to the smoking area. As long as they maintained their x number of hours per week, they could smoke, go to lunch, etc. as much as they liked.

anyway, imo its something that a manager needs to manage. Who cares how long someone smokes for , as long as the work gets done.

The US is very backward on this sort of thing. What about everyone else doing risky things? What about the added costs from people who do sporting activities? Are they controlling people's diets?

I wouldn't surprised if they were more productive. Nicotine is a stimulant

Rigid rules invariably backfire.

I never understand all the whining about smokers. I've never had reason to complain about it.
