So i bumped into someone

Second time this year! **** me! Although initial one wasn't my fault

Anyway happened when I was in parking bay reversing to get out and I just hear "bump" to discover that I bumped into a motorcycle that was behind me, wasn't there when I got into my car and didn't notice guy stop behind me as I was on my phone. So obviously his old bike fell over, breaking off a stand, footrest and clutch thingy. Thinking back at it, he had to be standing op my gat for this to happen, but non the less. First thing he asks is "do you have license" (I look young) I told him yes and helped him pick his bike up. I tell him the damage doesn't look that bad lets just sort it out among ourselves, but he insisted we go through my insurance, so we get to the police station to open up a case and they ask him for his driver's license, turns out he has an expired learner's license.

I obviously feel a bit of guilt, but he shouldn't even have been on the road in the first place!! What do you guys think should be my course of action?

but I think you got lucky. If he has no license then I'm pretty sure the insurance company will tell him to get stuffed.
Also why would he ask to go thru insurance when you offered to settle directly? That makes no sense unless he's going to try and milk you for everything he can get. The lack of license shoots that plan in the foot.
 
NO!!! I got into my car and read a text, put my phone down and proceeded to check my rear view mirror, start my car and move off.

That means you were distracted because you were using your phone while moving the vehicle.

I think that was his plan.

Just give them a full description of what happened and all details and let them handle it.
You pay them, so let them fight it for you.

True. Ja he wanted to go that route, don't even think his bike is registered. Lady Cop asked for license disc registration numbers, which she wanted to go check herself, but she's in a wheelchair and asked both of us to go and write it down, he then went home to go fetch, his now expired license, only to return without the bike, apparently it stalled when he got home. :erm:

Sounds like OP and biker should both stay off the road!

Nah, what do I know, I haven't had an accident in about 6 or 7 years and even that was not even me- two dicks on a bicycle road into the side of my car. Sounds like a joke. Lol, one was sitting on the handle bars!

Stay off that phone OP. But it just sounds like this oke is chancing his luck. Just let the insurance companies handle it, should be over with quickly.
 
As I see it the bike owner doesn't need a license to park his bike there. He could have pushed it there perfectly legally. This was not a moving violation by the motorcyclist. One needs a license to legally operate a motor vehicle on a public roadway, and he was not operating his motor vehicle. A friend of his who is licensed could have parked it there. You were operating your vehicle.

You wrongfully caused damage to his property and you should make good his loss.
 
Make sure you or he report it to the police AND have a case no. then inform your insurance <24Hr.
There is a chance he could try something it may not worth the risk for you to try and settle it. If you have a broker discuss it with him/ her.
