Hi all.

Haven't been on here in a while, but I received a not-so-pleasant letter from the local traffic department and they seem quite upset with the fact that I started accelerating out of an 80 zone en route to a 120 zone a bit prematurely and they want a grand from me as an apology.

I have heard from various sources that in our district if you do not receive a fine via registered mail within 30 days of the offense it becomes null and void but I would rather not chance a summons if I can avoid it.

I admit I was in the wrong because I started speeding up about 200 metres before the 120 zone, but I would if possible prefer not to part with R1000 if I can help it.

Any advice from the forumites on here? Admit guilt and hope I get a discount? Ignore it and wait for the proper registered letter?

Which region/district was the fine from?
 
Until you receive a summons...no need to worry about anything.

I've got two outstanding, and until they come knocking I'm not going to worry about it.
Plus, if someone else answers the door, they don't have to accept the summons. It has to be delivered and signed by you.

Um no. Your GF, mother, domestic etc can sign on your behalf if they are on the property and you will be in ***.
 
@mmmig, was my personal vehicle used for business purposes.

@LazyLion, apologies, forgot to add it was between PE and Uitenhage just at the Uitenhage/Despatch fork a hundred or so metres before the blue and white Freeway sign. The first 120 speed limit marker was a while down the road though so I probably won't be able to use that as my excuse. The offending pic has my car nice in the centre of the little black X so no getting away from it I am afraid. Oh, forgot to add that I was caught going 107 in an 80 zone

Criminal Procedure Act.
Section 54 (20 (a)The summons shall be served ...... by delivering it to the person named therein or, if he cannot be found, by delivering it at his residence or place of employment or business to a person apparently over the age of sixteen years and apparently residing or employed there.

Indeed, unless you say you are a visitor and don't know the home owners/residents very well and they have popped out to the shops, they will be back in 30mins. "No you can't sign on their behalf as you barely know them and can't get involved in their affairs."

It works, you do still need to be persistent that you don't know them and therefore will not sign, just politely tell the guy," but don't worry they'll be back in 30mins "

Op if the copy handed you the fine I'm your hand or it was a registered letter then that's a summons, pay immediately/appeal to the prosecutor for a reduction otherwise ignore till the summons is served.
 
I'm thought that the 300m is for speed reduction only.

Also the 30 days referred to in the OP is only applied if the date of the transgression and the date of processing the fine exceeds 30 days.
 
Hi all.

Small update to this query of mine. The date of transgression and the date of the issued fine are within 30 days. The fine was delivered 40 or so days after the transgression, so while I do not mind paying the fine (I was in the wrong after all), I did not account nor budget for a R1000 fine and I think the best course of action for me would be to have the fine reduced if possible.

Where do I need to go for this? Local magistrate's office or would the traffic department suffice? Anyone I can speak to in particular or should I go to the tellers and go on my hands and knees? :(
 
Dude, just THROW it away. In 16 years I have had to only pay 2 because it didn't let me renew my licence.

It just isn't worth it when there are no consequences.
