Sole Proprietorship - Registered Name

Hi there guys,

I'm hoping someone could help me with this :)

Well, I'm basically just starting of as a sole proprietor (The I.T Guy).
I have a Facebook page, domain (itguydbn.co.za) and business cards all with that name tied to it.
Now, I noticed that as a sole proprietor, I am allowed to start operating without actually registering the name or business.
The only problem, I noticed just a few days back on the CIPC website, that the name "The I.T Guy" is already registered.
What I would like to know is, have I put myself in a sticky situation and do I have to change my trading name?

You've put yourself into a sticky situation should the real IT Guy come after you :)
 
I actually did do a Google search.

There's no I.T Guy company in S.A. Well, I missed it if there is.

Most of what comes up on Google is overseas.

Well, I am thinking of a few names.

Any suggestions?
 
I'll just continue using the current name until the real IT asks you to change.

Just because a name is registered on the CIPC doesn't actually always mean its being used.

I've got four names registered for initiatives I planned to do over the years, but never got that far.
 
Thanks YingYang. I would rather change though as I wouldn't want to get into a legal debacle with the real I.T Guy... haha
Is it possible to find out who registered the name?
 
The company that issues the license for your company is supposed to check the name for you.
If the other "The I.T. Guy" is in a other country then you don't need to worry about it.
 
A sole proprietorship can operate under the name of its owner or it can do business under a fictitious name, such as Nancy's Nail Salon. The fictitious name is simply a trade name--it does not create a legal entity separate from the sole proprietor owner.

Can someone explain that to me?
 
If you are really get rid of this sticky situation then i would recommend you to register your trading them. You do have a option where you can entrust such task to the company who undertakes the services like Nuans Searches and Nuans Reports, numbered company registration, non-profit registration and so on. I do have a experience when i entrusted my trading name task to a reputed company which provides nuan name search services in Ontario. I would recommend the same to you
