#StateCaptureInquiry: Mantashe to reply to Hogan's claims

Johannesburg - ANC national chairperson Gwede Mantashe, who has been implicated by several witnesses at the state capture commission of inquiry, will lead the governing party’s delegation when it responds to allegations against it.

Zizi Kodwa, head of the ANC Presidency, on Tuesday said the ANC would respond at the end of the month to former public enterprises minister Barbara Hogan and the banks that implicated the organisation in efforts to stop them from closing accounts belonging to the Gupta family.

Kodwa denied that the ANC’s national working committee and the national executive committee discussed deployment into the government and state-owned entities (SOEs) as Hogan testified.

According to Kodwa, the commission can subpoena individual ANC leaders and members of the executive who have been implicated so far.
“Allow other people to come to the commission with their versions,” he said, adding that guilt should not be inferred on the basis of one witness.

Gordhan to testify later at state capture inquiry

JOHANNESBURG - Public Enterprises Minister Pravin Gordhan's testimony before the commission looking into state capture has been postponed to 19 November.

Commission chairman, deputy Chief Justice Raymond Zondo, said he had granted an application by Gordhan applied to move the date from Thursday.

''It is important that the public know that has been a change," Zondo said.

Gordhan's statement was leaked and widely reported on last week, prompting Zondo to issue a statement of condemnation.

Guptas may have paid for India trip, admits Barbara Hogan
Former public enterprises minister Barbara Hogan has admitted that both her and her late husband, struggle icon Ahmed Kathrada, had not known that a trip to India may have been indirectly sponsored by the Gupta family through their associates.
Testifying at the commission of inquiry into state capture, Hogan said Kathrada was invited by the SA High Commission in India to address various bodies in commemoration of stalwart Nelson Mandela. She said the trip happened after she was axed as minister of public enterprises.
She said the high commission had informed the Ahmed Kathrada Foundation that they were arranging the trip and thereafter forwarded plane tickets.

Jimmy Manyi has been singing like a canary at the state capture inquiry and gave a relatively impressive account of himself in front of the Zondo Commission.

The former GCIS chief pleaded with the hearing to let him begin his own testimony, when Barbara Hogan finished early in the afternoon. Mzwanele “Jimmy” Manyi wasn’t due to appear until 23 November, but his request to get going was granted, and he was obviously thrilled with the green light.

Manyi, whose allegedly close ties with the Guptas are yet to be investigated by the commission, went in hard on the Phumla Williams administration at the government’s media department. He accuses her of cronyism and corrupt practices that would only favour the Gupta family.

Zondo inquiry: I was told not to fix state-owned companies, says Barbara Hogan

Former public enterprises minister Barbara Hogan has testified that she had strict instructions not to fix state-owned companies, despite this being the main responsibility of her portfolio.

Hogan told the Zondo commission of inquiry into state capture on Wednesday that an interministerial committee was established by the cabinet to deal with problems in state-owned companies (SOCs), effectively stripping her of her powers.

The committee was supposed to provide recommendations on the funding model for SOCs and how government would deal with their financial woes. Hogan was part of the committee as minister of public enterprises. However, she was surprised when then president Jacob Zuma announced a commission of inquiry that would look at governance and other issues at SOEs.

She said Zuma, who announced the commission of inquiry during one of his state of the nation speeches, did not indicate what would happen to the interministerial committee.

"There was a lot of confusion about this, as to whether the committee set up by cabinet would still go on with its work. At the time, the president’s office seemed to suggest the two processes would run parallel. But finally, Mr (Collins) Chabane (the late former minister in the presidency) clarified that the inter-ministerial process would be cancelled," Hogan said.

She said Zuma gave her strict instructions not to interfere with the work of state-owned companies until the commission had finished its work.

Manyi storms state capture inquiry without lawyer

Unorthodox in his presentation, Manyi insisted on testifying despite a scheduling error, and waved a report from Treasury ‘proving rampant graft’.
Who would dare to testify at the Commission of Inquiry into State Capture facing Deputy Chief Justice Raymond Zondo without a lawyer?

Mzwanele Manyi would.

He is the former chief executive officer of the Government Communications and Information Systems (GCIS).

Unlike the son of the former president, Duduzane Zuma, who earlier in the morning arrived accompanied by a group of lawyers to confirm a date for the cross-examination of former finance deputy minister Mcebisi Jonas, Manyi was only armed with some documents, which did not quite constitute a proper legal bundle.

And he got some people in the public gallery giggling yesterday as he made an appeal to Zondo to address the commission.

“I was summoned to appear here today and had prepared myself psychologically last night,” said Manyi.

Zondo said he regretted the summons error made by the commission’s legal team. He suggested Manyi should instead testify fully on November 23 “to give you time to prepare”.

National Treasury has released a bombshell report of more than 600 pages detailing the extent of rot at Transnet and Eskom over the last six years – and says Malusi Gigaba compromised the procurement process of controversial new Chinese locomotives.

The report, compiled after a forensic investigation by Fundudzi Forensic Investigation Services, found widespread irregularities, improper and illegal payments and flouting of good governance laws.

The investigation specifically looked at the deals between Eskom and coal producer Tegeta, the contracts between Regiments Capital and Trillian Advisory Services with both Eskom and Transnet as well as management consultant McKinsey. Tegeta, Regiments and Trillian are all Gupta connected or owned.

Other findings include:
- Senior Eskom executives violated financial and anti-corruption laws in awarding lucrative coal supply contracts to Gupta owned Tegeta and for a R659m 'pre-payment' for coal also paid to Tegeta.
- Former chief financial officer Anoj Singh and former head of generation Matshela Koko both misrepresented facts to the Parliamentary Portfolio Committee on Public Enterprises in relation to a 3.5% discount they claimed Eskom had negotiated with Tegeta in relation to the coal supply.
- Singh and McKinsey compromised the integrity of the procurement process at Transnet by sharing details of the process before the contract was awarded by then Transnet CEO Brian Molefe.
- McKinsey and Regiments started doing work for Transnet before an agreement was reached and that it and Trillian were paid for expenses without producing supporting documents.
- McKinsey, Regiments and Trillian were paid R1.5bn by Transnet between 2012 and 2016.
- Transnet made an irregular payment of R94m to Trillian .
- The appointment of McKinsey to Eskom was "not in line with the Constitution".
- Molefe, Siyabonga Gama and others compromised the integrity of the procurement process for the Chinese locomotives by changing the prescribed conditions for the bid after it closed.
- Transnet officials "went out of their way" to assist China South Rail, the eventual successful bidders for the new locomotives.
The investigators urged Treasury to act on their investigations to address the underlying issues at Transnet and Eskom and to not only treat the "symptoms" of governance shortcomings.

Johannesburg - Axed Transnet CEO Siyabonga Gama has criticised former public enterprises minister Barbara Hogan for her testimony at the Zondo commission of inquiry into state capture.

Hogan told commission chairman Deputy Chief Justice Raymond Zondo earlier this week that the former president Jacob Zuma had pushed for Gama "and no one else" to be appointed CEO. She also testified that she was unfairly treated by the pro-Zuma camp.

"I cast as an anti-transformation racist who did not appreciate the necessity for transformation in this country," she said.

Zondo postpones Mentor, Nene's appearance at #StateCaptureInquiry

Johannesburg - Former ANC MP Vytjie Mentor's appearance at the state capture inquiry has been postponed as her legal team seeks more time.

Mentor was due to return to the witness stand this week, but the commission's legal team have told commission chair Raymond Zondo that they need more time to investigate before she is allowed to appear.

More of a knee-jerk reaction by a cadre than a "slam" imo, he's got the wrong end of the stick anyway it seems:
"For instance, it is an irrefutable fact that due to Mr Gama’s proven track record of accomplishments within the Transnet group, he was more than well-qualified to apply for the position of GCEO."

Nobody was saying he was not qualified enough to apply, the question is whether Zuma had influenced the decision to appoint him. He could have all the qualification in the world and still not deserve the job if he got it illegally.

JOHANNESBURG - Former ANC MP Vytjie Mentor has backtracked on what she told the state capture commission under oath about her first encounter with Gupta-linked businessman Fana Hlongwane.
Mentor has now apologised to Hlongwane for implicating him at the state capture inquiry.
Eyewitness News has seen a letter Mentor’s lawyers have written to the commission this week in which she says she erroneously referred to Hlongwane as the man Duduzane Zuma introduced him to on a flight to Dubai in 2010.
In August Mentor testified at the inquiry and described how the president’s son approached her while en route to China and introduced her to two members of the Gupta family and the controversial businessman.

Backtracking on Fana Hlongwane ‘may affect rest of Vytjie Mentor's evidence’

Cape Town - Analysts have warned that the retraction of evidence by former ANC MP Vytjie Mentor about meeting businessman Fana Hlongwane on a plane could impact on the rest of her evidence, but would not have a huge impact on the work of the Zondo commission of inquiry into state capture.
Mentor on Friday withdrew part of her statement at the inquiry, in which she said that Duduzane Zuma had introduced Hlongwane to her during a trip to China.

She had previously said in testimony a few months ago that Zuma was with Rajesh Gupta on the plane when he introduced Hlongwane to her.

Head of politics at Unisa, Professor Dirk Kotze said it was not the first time there had been a question mark around the evidence of Mentor.

“It’s not the first time there are questions about whether her memory is strong. That is why her evidence does not carry the same weight as that of former deputy minister of finance Mcebisi Jonas,” said Kotze.

Jonas had testified to the commission that Zuma had introduced him to Ajay Gupta and the latter had offered him R600000 in cash if he would agree to succeed his then boss, Nhlanhla Nene, in 2015.

On Friday, Eyewitness News reported about the contents of a letter the former ANC MP’s lawyers sent to the inquiry where she apologises for naming Hlongwane as the man Duduzane Zuma introduced her to.

Stats SA slams Manyi's testimony at State Capture inquiry

Johannesburg - Statistics SA on Friday shot down former media owner Mzwanele "Jimmy" Manyi's testimony at the state capture commission of inquiry that it paid R64 million to a contractor who failed to deliver work for the 2011 census campaign.

"Stats SA can confirm that it indeed paid a service provider R64 million for creative advertising concepts and production services that were rendered during Census 2011, in compliance with all supply chain management prescripts. The organisation has complete trust in the work of the Zondo commission and will cooperate with the commission on all matters relating to this issue," the organisation said.

A confident Manyi insisted to take the stand on Wednesday at the commission, although he is scheduled to be cross-examined next week after Government Communication and Information System (GCIS) boss Phumla Williams implicated him in her evidence at the commission.

Zondo Commission wants proof that Nombembe leaked Gordhan's statement

JOHANNESBURG - Deputy Chief Justice Raymond Zondo has called on those who've accused the state capture commission's head of investigations Terence Nombembe of leaking information to come forward.
It's being reported that Nombembe leaked Public Enterprise Minister Pravin Gordhan's statement to the commission because of this close relationship with him.
