State capture inquiry: Mosebenzi Zwane appealed to Nedbank to save Gupta jobs

Former mineral resources minister Mosebenzi Zwane directly appealed to Nedbank’s CEO‚ Michael Brown‚ to “step in and save jobs” by reopening closed Gupta company accounts - stressing that Gupta family members had stepped down from these companies.
Brown said Zwane appeared to know that Nedbank was not the Gupta family’s “main transactional banker” and went on to “suggest that would Nedbank consider stepping in to save jobs and provide an amicable solution‚ given that the relevant family… had resigned from those companies”.
“I found it (the request) particularly strange… I reminded Mr Zwane that we were not here to discuss particular client matters. Our decision for closing the accounts was based on the reputational and business risk associated with those accounts and that reputational and business risk would not have materially changed at all as a consequence of resignation of directors‚” Brown told the Zondo Commission of Inquiry on Wednesday morning.

Deputy Chief Justice Raymond Zondo has dismissed former public enterprise minister Lynne Brown's application to cross-examine former deputy finance minister Mcebisi Jonas during the State Capture Inquiry.

Brown had brought forward the application to challenge Jonas' testimony, in which he told the commission that Ajay Gupta had offered him then-finance minister Nhlanhla Nene's position. Jonas said that Ajay told him that he worked with Brown.

On Thursday morning, Brown's legal counsel Advocate Simmy Lebala tried to lay out the context of this matter, but Zondo grew increasingly impatient with him, reminding Lebala of his dwindling time, and calling for Brown's version of events.

According to Zondo, the requirement to be able to cross-examine a witness on an allegation is for the cross-examiner to present their version of events.

Zondo explained that he could not grant cross-examination if the applicant admitted to allegations, and once Lebala's 15 minutes to lay out Brown's case expired, Zondo made the call.

"Miss Lynne Brown's application is dismissed. She has not put up her version and I am not at this stage prepared to grant her leave to cross-examine," Zondo said.
 
Ajay gupta wanted to cross examine Jonas as well. This looks like another attempt via proxy. I wonder if bra jacob will attempt this as well?

While Brown has not been formally served with a notice that she is implicated, she has had legal representation at the Commission for most of its sessions since 20 August.

This has been quite remarkable in view of the fact that most of the lawyers for implicated parties appear to come and go depending on whether there is testimony on the day which implicates their client.

Those representing former president Jacob Zuma and his son, Duduzane, the Guptas and arms deal-era adviser, Fana Hlongwana, were out in full force at the State Capture Commission during the testimony of Jonas, former government spokesman, Themba Maseko, former ANC MP, Vytjie Mentor and current acting government DG, Phumla Williams.

But by the time the Guptas application for cross-examination via video link was crushed, the legal bench on the fourth floor pretty much emptied out – except for team Brown whose attorney has been present almost daily.
 
Hawks say Mcebisi Jonas 'defeated the ends of justice'

Former deputy finance minister Mcebisi Jonas has been slammed by a senior official in the Hawks for allegedly being negligent and tardy in cooperating with the police's elite corruption-busting unit in its Gupta investigation.

Major General Zintle Mnonopi further accuses Jonas of "defeating the ends of justice". Statements he has provided, detailing the infamous meeting in 2015 where Ajay Gupta allegedly offered him a Cabinet post and R600m, are "incomplete, shallow and not comprehensive", says Mnonopi adds.

In a sworn affidavit, released by the commission of inquiry into state capture on Thursday, Mnonopi slams Jonas, who told Deputy Chief Justice Ray Zondo in August that the Hawks were reluctant to investigate his claims. He told the commission that Mnonopi referred to the matter as "a DA matter" and that he felt the police wanted to quash the issue.

In her affidavit, Mnonopi says Jonas defeated the ends of justice because "he failed to open a case timeously, thus the Guptas were not arrested and have consequently freely left the country because no warrant [of arrest] was issued".

ANC secretary general Ace Magashule says he is prepared to testify at the commission of inquiry into state capture, if he is implicated in any wrongdoing. Magashule made the remarks during a lecture he delivered to members of the South African Students' Congress (Sasco) in the Free State on Friday.

In a move straight out of former president Jacob Zuma's playbook, Magashule chose his home province as the place where he made his first public speaking engagement following a blistering address by ANC president Cyril Ramaphosa to those alleged to be plotting his removal from his roles as leader of the party and the country.

Magashule has been linked to claims of a plot to unseat Ramaphosa, which gained traction after a photograph was published in the Sunday Times newspaper showing him at a Durban hotel with ANC Women's League secretary general Meokgo Matuba, ousted ANC North West chairperson Supra Mahumapelo and Zuma.

"Let me tell you, nobody can stop me from meeting president Jacob Zuma. I will even invite president Jacob Zuma to come and talk to you as students," Magashule told cheering and clapping Sasco members."There is no ANC leadership which I am part of, that is going to stop me and many others from meeting president Jacob Zuma," he said of the former leader he kept referring to as president.

"People are talking state capture, I am prepared to go to that commission if I am also implicated," said Magashule. He added that this would give him the opportunity to "relate many other stories" to the commission spearheaded by Deputy Chief Justice Raymond Zondo.

"If you want to charge us as leaders, you must take us one by one to check which leader is part of white business," said Magashule.

Looks like he also does not believe in state capture. I had no idea that being part of white business was a crime.

Johannesburg - A busy few weeks lie ahead for the Commission of Inquiry into State Capture with a number of high profile witnesses set to take the stand.

Former finance minister Pravin Gordhan is expected to testify next month, followed by current Finance Minister Nhlanhla Nene, and then former public enterprises minister Barbara Hogan.

Head of the commission's legal team Paul Pretorius said the commission would call new witnesses next week but added that it was inappropriate to name them.

How Zwane duped banks to a ‘fake’ committee meeting
Former mining minister Mosebenzi Zwane may have manufactured an inter-ministerial committee (IMC) and used it as a platform to summon banks in his bid to save Gupta-controlled companies.

The state capture commission of inquiry, sitting in Parktown, heard from witnesses from the four major banks earlier in the week of how each of the banks were summoned - through email communication - by lawyer Zarina Kellerman who identified herself as the secretary of the committee, to an ‘IMC’ meeting allegedly constituted by cabinet on April 13 2016.

Standard Bank and Nedbank eventually honoured the invites, while FNB and Absa did not.

However, it seems there was never an IMC to begin with and, according to a letter penned by the then finance minister Pravin Gordhan to Zwane and a Cabinet statement communicating decisions of that particular Cabinet meeting, there was no such decision to establish an IMC.


According to the Cabinet statement of the meeting, Cabinet acknowledged the moves by the banks to close the Gupta accounts and assigned three ministers to engage the banks. The statement is mum about the formation of an IMC and it is unclear if the three ministers were a task team or IMC.

“Cabinet noted the actions by the four banks that gave notice to close the bank account of a company. Whilst Cabinet appreciate the terms and conditions of the banks, the acts may deter future potential investors who may want to do business in South Africa. Cabinet has endorsed that the ministers of finance, labour and mineral resources should open a constructive engagement with the banks to find a lasting solution to this matter,” the cabinet statement read.

The letter penned by Gordhan to Zwane at the time also states that “no inter-ministerial committee was established,” although ministers - including Gordhan - were nominated but no convener was designated.

Zwane met with Standard Bank alongside Labour Minister Mildred Oliphant and chaired the meeting, which according to the bank was an IMC meeting.

Legal advisor to Oliphant, Nonkululeko Mabandla confirmed to City Press that Oliphant did attend the meeting with Standard Bank but was not present at the meeting with Nedbank.

She, however, also pointed out that Oliphant attended the meeting in her capacity as a member of a ministerial task team, not any IMC, which would be a different committee altogether.

Zwane also chaired the alleged IMC meeting with Nedbank even though he was the only minister present. The meeting was attended by Nedbank chief executive Mike Brown, his two colleagues, Zwane, Hebert Mkhize, Kellerman and two unnamed officials.

Mkhize confirmed that he was present at the meeting as an “observer and was there just to listen”. However, after initially saying he did not know if his then principal Oliphant was present, Mkhize said the question should be redirected to Brown.

Numerous attempts to get hold of Zwane were fruitless and Cabinet spokesperson Phumla Williams declined to comment on the matter.

Questions sent to Kellerman were not responded to and in a text message she confirmed that she would not comment.

The investigations unit at the Sunday Times played a crucial role in the destruction of the Hawks and SARS – and its members need to come forward and explain their roles in arguably the worst journalism that has ever been perpetrated in this country.

It will be unusual for journalists to testify before a commission, but there are clearly instances where they weren’t reporters but propagandists.

They will claim confidentiality of sources, which should be sacrosanct in journalism.

But surely, when a source abuses your trust, lies to you and uses you for ulterior purposes he/she is not entitled to any protection.

Mentor is an easy witness to discredit because she really comes across as lacking credibility. But is Ajay think she needs cross examination why doesn't he get over here and cross examine her?

And this thing about chopped up mutton, is it that he dislikes the curry stereotype or they eat they mutton some other way. And if they have a chef surely they prep to the guest's preferences not what they themselves would necessarily eat?

Edit: Something that always puzzled me, was how the whistle-blowers came to "legally" be in possession of the documents. The article hints (IMO) that it was a crashed hard drive, that was disposed of without completely destroying the contents. To safeguard their identities, this information was not previously disclosed.

Currin: SA owes huge debt to whistleblowers for Gupta Leaks emails

JOHANNESBURG - Lawyer Brian Currin said the country owes a huge debt to two whistleblowers who lifted the hard drives containing the thousands of emails known as the Gupta Leaks.

Currin testified at the state capture inquiry on Thursday about how he transported the three hard drives from Nairobi to South Africa.

The hard drives are now in the possession of the commission of inquiry.

Currin said the two whistleblowers identified as Stan and John are not yet willing to testify out fear for their personal safety.

Zondo raises concerns about admitting Gupta Leaks data as evidence

JOHANNESBURG - State capture commission chair deputy Chief Justice Raymond Zondo says that he is concerned about admitting all the data contained on three hard drives as evidence without first analysing it.

The hard drives contain thousands of emails, widely known as the "Gupta Leaks", which detail alleged correspondence between the Gupta family, government officials and chief executives of state-owned companies.

Duduzane Zuma denies bribery offer to Jonas, alleges blackmail talk

Former president Jacob Zuma’s son Duduzane has denied any knowledge of a job offer and a R600 million bribe offer made to former finance minister Mncebisi Jonas at the Gupta’s Saxonwold compound three years ago.

While the younger Zuma conceded he did meet with Jonas on the day at a Rosebank hotel and then moved to Saxonwold, he denied that Ajay Gupta was part of the meeting that included businessperson Fana Hlongwane.

Zuma submitted an affidavit to the state capture commission of inquiry as part of his application to cross-examine witnesses. He said his first interactions with Jonas started when he wanted to invite him to the Gupta family’s event, the South African of the Year, which Jonas never attended.
