State capture inquiry begins

Zondo: there has been an agreement that the decision that the former president will no longer participate in the proceedings is withdrawn.


The president will then prepare statements in response to each of the issues raised in the witness statements, Zondo says.

I hope they know what they are doing. He's an expert at sticking to a script and not deviating from it...

Don't think so...more a case of , either do this willingly or i will subpoena you ...
Zondo, like his peers, may seem rather tame ...but they have teeth, and know when and how to use them...as he laid out, he heads this commission...his whole speech was to put Zuma and his team on notice, -not on my watch are you going to do your circus crap here...
but all in all.,..this whole episode is typical Zuma...
 
But after a concession - he will be told what specific parts of witness testimony he will be questioned on, and will then prepare a statement on it.

Like he can write. This is so infuriating. His legal team will write the response and the brain-turd will then read from a script - again.

If that were the case, they could have resumed immediately.

Now the fecker has 2 weeks for his legal team to to prepare carefully crafted statements about specific incidents that they intend on questioning him about.

A courtesy not extended to anyone else. Should have just let him walk and subpoena him...

It's essentially giving him the questions beforehand, which he asked for and was denied previously. What a farce.

The question is now whether he may answer those questions in his own time than to participate in the proceedings.

I like how Zondo said that it may have seemed long, but that it took 10 minutes to come to a solution. Special treatment, yes.

They cannot wish to cross-examine the witness or to call on the witness to give evidence. Zuma can prepare in advance. A move has been made against Ramaphosa today, I don’t see him capable to respond to something where the implicated person doesn’t understand but where he served as his deputy.

1 Option is out, the only other option to make a recommendation to the president to submit Zuma to an independent enquiry, or he walks. I don’t understand the part where Zuma will no longer participate in the proceedings, is it now or is his participation postponed?

I don't agree with Zondo here, Zuma should have been compelled.

it is frustrating , but has to be done...above reproach , this whole damn thing must be...so when the NPA comes a knocking, can not have the whole, process was flawed defence. Trust me, Zuma and team, did not expect Zondo to roar, like he did. + The PP releasing her report on CR at the same time, indicative of them (Zuma+ ilk) having calculated that CR issue would consume the news cycle more...till Zondo roared and they had no card to play.

Zuma’s legal team may now choose to delay any proceeding as they have done in the past. Zuma has now also dismissed all accusations (and testimony) made against him where he has been implicated by witnesses. This commission is bound by time, it will be up to the president to decide once the recommendations and report have been made. Who knows, the ultimate decision may weigh on the next SA president…

The whole point of what happen in the commission today was to keep the process 100% above reproach. Zondo is aware that Zuma will lie through his teeth and duck and dive answering questions directly even when given 2 weeks to formulate his responses. This plays more into painting Zuma as a unreliable witness so his testimony will hold less weight when it gets into a court of law.

Zondo has well and truly played Zuma and his legal team. He has painted them into a corner that they will struggle to get out of. Jacob incriminated himself in the commission, and now they will have to make 100% sure that the prepared statements they present do not contradict anything he has said so far.

There is a problem from a witness point of view when that witness is meant to be the person ultimately responsible for running the country. There is a level of accountability at play here as well which would not apply to the average citizen.

Amendment of regulation 8 of the Regulations

2. Regulation 8 of the Regulations is hereby amended by the substitution for subregulation (2) for the following: (2) [No evidence regarding questions and answers contemplated in subregulation (1), and no evidence regarding any fact or information that comes to light in consequence of any such questions or answers, shall be admissible in any criminal proceedings, excepts in criminal proceedings where the person concerned is charged with an offence in terms of section 6 of the Commissions Act, 1947 (Act No. 8 of 1947), or regulation 12] A self-incriminating answer or a statement given by a witness before the Commission shall not be admissible as evidence against that person in a criminal proceedings brought against that person instituted in a court, except in criminal proceedings where the person concerned is charged with an offence in terms of section 6 of the Commissions Act 1947 Act No. 8 of 1947

Section 6 also doesn't apply to Zuma in this case as he has reached an agreement with the Zondo Commission to give testimony at another time. It is also not up to the Zondo Commission to initiate Zuma's prosecution, they may, however, make that recommendation to the president which must make that decision based on the Zondo Commission's report.

Either way the self-incrimination angle may have been used by Zuma and co to ensure his testimony at the commission can't be used against him in any criminal proceedings going forward.

How then can a criminal case be made against him if his testimony in the commission is inadmissible?

100%... but it all paints a picture for the judges outside of the commission if things ever do get to court.... Zondo is no mans fool and is fully aware that what he is doing may not end up in any specific charges, but there will be a chunk of stuff that can be referenced should things end up in court.

This was a decision made last year which was signed in my current president, Ramaphosa, because witnesses didn’t want to give testimony without implicating themselves.

The commission chooses to receive testimony in a certain order to establish a cross-examination process. The process is in their rule book which the Zuma legal team argues against due to a simple technicality, in regard to being granted leave, and then changed that into a motive where Zuma is being cross-examined, being connected in the previous testimonies. In the USA they have the 5th Amendment (which is Constitutional), but in Zuma’s case, it would be wise to deny the other witnesses testimony by either being unaware or too vague to remember.

This is why Pretorius will ask questions without having the current witness stepping into a scenario where his testimony shall not be admissible as evidence. He used Hogan’s testimony against Zuma, and Zuma’s legal team was expecting that and that was when they intervened. Pretorius asked normal procedural questions in order to give Hogan’s testimony credibility. The commission’s legal team is building a case, they are connecting the dots. They used this opportunity to have Zuma support the other testimonies.

The only testimony Zuma gave was calling out comrades as spies, implicating others in state capture and calling on the Third Force as the might behind the current circumstances.
