Agreed.. but in reality having 100's of kids running around a school it's impossible to stop all accidents. Kids needs to take responsibility too. He was in HIGH School. They were in a no-go zone, so they disobied the rules of the school. So now teachers have to watch every no-go, playgrounds, the stands/pavilion,bath rooms , bicycle storage, class rooms etc...?

What about kids smoking? Can the schools stop them? What about kids misbehaving ... schools can't do everything...

Only way to ENSURE safety is by putting the kids in the main hall and let them sit there during break. Then nothing will happen.

This sets a very very nasty example.

A: there is no way in hell I hope our schools can protect kids from there own stupidity. So you have an open gate to more claims that you can do nothing about.
B: this gonna hurt future education more than anything else, money has to come from somewhere and Education can only access their part of the budget, which comes from OUR tax money. More money for pay outs, less go into Teacher payrolls and actual teaching.

You can be classified as disabled and still have all your brain facilties in tact.

How serious are these burns, does it affect his walking in any way? To be listed as a disabled by your Company you have to get a Dr's "letter" to state and certify your disability. If this was done the correct way, this chap can get some benefits as well from SARS *wink*, but obviously there is paperwork involced...

My stupid question : Are there no type of "insurance cover" companies can take out if they, in this state Education Dept, get involved in law suits as these?

No he can not.

Source: I am disabled as per EE, (Blind in one eye) but pay the same amount of tax on earning as everyone else.

End of the day its still Tax money that is gonna get used.

Insurance needs a premium to be paid, Cover cost is based on risk. the higher the risks of payouts the more cover is gonna cost, its not like Insurance co's grow money.
 
Very bad court decision. We can expect this to result in the kind of ridiculous anti-play rules that have become commonplace in other countries because schools are terrified of being sued.

It is an estimate of future earnings, or at least future earning potential. It is done by actuaries, not a complete thumb suck.

Wondering who funded the trial and appeal in the first place. It sets a good precedence though as schools are rife with bullying and since the parents can't manage their bully-kids, let the schools pay for it then.
 
So he is studying at law school. If he ends up living a normal life and earning a good salary, does he have to pay back the 23m with interest when he retires at 60?
