Telkom astronomical bill

It is heart warming to see that advice is offered to a fellow ripped-off customer.

Actually, those that know me on this forum --- I used to be a much more regular participant in forum threads than I am now --- know that whatever legal help I can give to MyADSL victims of Telkom is always given free of charge: that's been a long-standing thing for quite a while now. It's just that it's been so long since I was last really active on the forum that I thought I'd better make the position clear for this member (branden) whose whole business seems to be at risk because of his particular problem.

Thanks for the offer.

We have had a meeting with Shepstone and Wylie and they feel we should pay as Telkom did notify us and our accounts person did not take any action.
I still think that out of principle, we did not use the service and it was a genuine fault, either ours or Telkom’s that we should still per sue it. We have a standard setup in all stores we do and they all get software updates at the same time.

We have found out that is we were on a different package, which our Telkom rep should have advised us, the bill would have been less than R40k for the exact same amount of calls, so in my mind I do believe a payment of R40k should be acceptable, that way Telkom does not lose revenue, although I would prefer to not pay them at all.

I have had 2 cases like this before, one for R70 000 and one for R150 000, both cases was the customers fault. One guy had his internet setup on dial ondemand, he then changed his password, leaving his PC trying to dialup once per minute. Second guy actually wrote some code to monitor the b channels on his isdn, this causes a call every couple of seconds.
In both cases the guys had to pay, Telkom did however agree to have them pay in installments.

WHile I was an practising attorney I represented a guy who set up an internet cafe back in the day when there was no such thing as ADSL. The people that set his connection up for him messed up and like with you, hsi connection kept geeting closed and his system was dialing in every few seconds. Instead fo getting one long connection, like with that R7 deal they used to have, he was essentially making THOUSANDS of calls a day. His bill came to R370 K for about two months...

What happend to Telkom's famous credit control - you are calling too much, if you don't pay R1000 within the next 5 minutes your line will be suspended.

Oops your account has just gone above the immediate cuttoff limit ... Bye...

Did he have to pay?

It was many years ago and cant remember all the facts. But basically, my assesment at the time was that he had a damages claim against the person who set up the system for him. The damages arouse out of the negligence of the person who set it up for him. From Telkom's perspective he was liable, and would have to pay. Like I said above, he could however sue the contractor who set it up for him for the same money back. however, teh **** up was that the dude didnt really ahve the cash to pay telkom and he couldnt sue the contractor until he paid. This is because technically, in terms of the law, he would not have suffered damages until he had actually paid.

Before I could take the matter anywhere I moved law firms... This was during the second year of my two years of articles. In a year, very little happens, and I changed firms before the matter was resolved.

BUT, he WAS technically liable to Telkom. We went through his telephoen account... was ridiculous. each months was about the thickness of a big phone book and a half, with ALL these calls to the same number over and over and over, 24 seven for like 2 months!! Horrible :sick::sick::sick:

They really should have proper credit limits in place.
