...condition 9 of the Telkom SA public switched telecommunication service licence deals with the issue of fair trading. Telkom SA is not permitted to show undue preference to, or exercise undue discrimination against, any persons in respect of the provision of any telecoms service.


Furthermore, the clause stipulates that the licensee may not unfairly favour to a material extent any business carried on by it so as to place at a significant competitive disadvantage persons lawfully competing with that business.

So let me see if I understand what Telkodemonopolies is saying here - considering the previous Competition Commission & Tribunal case brought against Telkodemonopolies by the ISPA several years back, and the more recent ISPA case against Telkodemonopolies that is still pending, and the numerous objections to Telkodemonopolies' BCX merger currently before the Competition Tribunal, Telkodemonopolies is admitting to being in violation of its licence agreement with !CASA...?
