What is Temporary Resignation?

The company I work for is currently without any projects and we are a few senior staff sitting around doing nothing. My boss is trying to make a deal with a competitor in another province to employ us temporarily until our company's projects start early to mid next year.

I was hoping for secondment to the other company but my boss mentioned Temporary Resignation today.

We have a meeting tomorrow morning to discuss this. I have a feeling he wants to get away with not retrenching us. Between the 4 of us, our service to the company is 4, 5, 10 & 15 years.

What happens to all our leave payouts? Will he want to freeze our leave until we return to the company.

Any advice or even comments for me in preparation for tomorrow.

TIA

Speak to a labour lawyer or ccma representative asap, don't sign anything

I'm a bit late to really help but there is no such thing as a temporary resignation.

What your boss may be looking at is implementing reduced work time. There are requirements in order for it to occur, one being an agreement between employer/employee.

With reduced time, you still remain an employee of the company, so when things pick up, he has to reinstate full time. You will also be eligible to claim from UIF for any loss of income.

Do not agree to anything that refers to resignation. Resignation is also considered voluntary and you will not be eligible for UIF.

Ok so the boss offered us a reduced salary for the period until our projects pick up again. So it looks like I'll sit home for the next 6 to 8 months.

Interesting that I could claim from UIF for the reduction in salary. I'll have a look into this later this evening.

You just need your boss to issue you a UI19 form.

On his payroll he would have "ended service" with reason "Reduced Work Time" which then get's submitted to UIF when he does his uif submissions.

I quote ended service because legally you are not terminated but it's the process for declaring reduced time.... at least on the platform i use.

Can anyone tell me what the maximum amount one can claim from the UIF is?

Not specifically for me, but just out of interest sake.
