My tenant haven't paid their rent yet - and blame the company for short paying etc etc It's the 2nds month they've been there and already they're 10 days late.

What can I do? I'm guessing because I'm 28 and quite soft, they think they can walk over me.

Anyone here a lawyer and can maybe just give the guy a call to let him know? ;)

If your rental agreement is with your tenant, it is of no consequence that their company did not pay them. It it between you and the tenant and not you and the company.

Ouch - this is a bad start - send them a registered letter demanding ASAP payment... so you have it recorded.

Personally, I would try and get rid of them immediately.

Actually, I would go around with a huge hammer, and do it illegally - but thats just me :p

What I'm concerned about is their previous landlord of 5 years, had no issue (so he says). This may well be really bad, bad luck on the tenants part ...

Hence hammers are out ;)

You cannot let them make their problems yours. This is the advice I got from a landlord friend: Tell them if they they think they have problems because their company didn't pay them, they are really going to have problems when they don't have a place to stay. Then go in there and start throwing their stuff outside.

As mentioned in your other thread on this issue, I would insist on a debit order.
The debit order is not 100% fool proof, but it does not give the tenant the flexibility to place you down the list when he decides who to pay at the end of each month.

Some here are offering advice that could get you into trouble.

Do you have a signed lease agreement? - if so it should state that they are liable for the costs of recovering arrears rent, such as a lawyers letter etc.

Best way to get a tennant out is to remove the front door.

Like your already getting new ppl for the place.

Do you belong to some sort of agency? I don't quite know how it works, but if you belong to one, they can sort out these issues for you.

Nope. I had an agency for 18 months and they were just as bad - and I paid them R800.00pm to do nothing. I decided to try go the direct route and use an insurance company, but they never answered my questions and ignored mails.

I'm pretty much alone.

However if he doesn't pay by end today, I'm drafting a letter and if I get new tenants, I'll go the insurance route. I need to try everything once.

I've realised an agency (management) doesn't work and neither does an agency (finder only).

If they never have been a problem to anyone else, then it's just bad luck (work wise etc)

I've been with this company for 6 years, and there has only been a stretch of 3 months where I was paid really late - it has been corrected but of cause, I paid everything late :(

If your company does not pay you ontime, request from them a letter that states that, so that you have some proof to show to your landlord. It's a poor excuse to use. :mad:

I'm interested in how this turns out since i also wanna get into the renting places out market. :D

I've been messed around for 18 months from Just Letting and thought that was aonce off bad experience. They left end November and I've just sepnt R60,000.00 over 3 months fixing items for the new tenants. Now they too, seem to be messing me around.

I'm itching to draft a letter saying that I am seeking advice from my lawyer ... ;)

Just letting certainly gives this business an even worse reputation than they have.
I haven't had any major issues with the rental company I use.

What does the lease agreement state about late payments and the course of action?

There was this renting agency that was advertised on Radio 702. Apparently you are guaranteed your payment on time without the hassle of going to them lawyers and you don't have to pay anything or something like that. I forgot the name.

we are currently going through a similar problem

our tenant lost his job (but more likely he was fired because he is a lazy slob) and was unable to pay rent. he ALWAYS paid late but he was mostly good with regards to paying, but it has been more than a month now and we already had to pay extra interest on the mortgage.

a LOT of lies and sweettalk later, we had enough and decided to break the law by denying him access to the room. we also decided to remove all our possessions and furniture (the room was 100% furnished by us) and oh boy what a "fun" experience that was. the white walls were smoked YELLOW and theres a thin film of grease/dust/filth/grime/tar/etc on everything. all the dirty dishes were stored in drawers and has a thick black coating of fur on it (farming mushrooms without our consent? tsk tsk). we even found a pack of frozen chicken in the freezer expiry dated 2007/11, but otherwise the fridge was bare, as in NOTHING. the mattress and bedsheets need to be destroyed because of the stench.

long story short, the tenant brought the police over to try and gain access, but we however told them that without a warrant they will not be allowed since we need to protect ourselves as well. luckily for us the tenant does not have money to take things further and has opted for the "easy" way out by removing himself from our property. we were lucky
