Three men accused of killing gay nightclub owner Bruno Bronn appeared in the Western Cape High Court on Monday.

John Frederick Coetzee, Fareez Allie and Achmat Toffa appeared before Judge President John Hlophe, who said their trial would begin on August 26.

It was to have started on Monday, but the court heard that a new lawyer had come on record for Toffa and would need time to prepare.

The men would appear in court again on August 19 to ensure they were ready for trial.

Coetzee is out on bail of R20,000 and Allie of R5000.

Toffa was granted bail in this matter, but remains in custody at Pollsmoor Prison on two unrelated charges.

Bronn, 50, was found murdered in his Green Point home on February 7 last year. According to the indictment, he was strangled and died of suffocation.

He owned the popular nightclubs Bronx and Navigaytion in Somerset Road, Green Point.

The men face charges of premeditated murder and robbery with aggravating circumstances. Both charges carry life sentences.

The State previously withdrew charges against a fourth accused, Kurt Erispe. The reason would be revealed in the trial.

The State said it had drawn up a list of 48 witnesses although not all would be called if the men made certain admissions ahead of their trial.

Arrest warrant for Bronn murder suspect

The Western Cape High Court on Monday issued an arrest warrant for one of the men involved in the murder Cape Town nightclub owner Bruno Bronn.
He was found strangled in his Green Point home in February 2012.

Earlier on Monday, the three accused were ordered to appear in court but only John Frederick-Coetzee and Fareez Allie turned up.
According to Achmat Toffa’s lawyer, she received a message this morning from her client saying he was suffering from kidney problems and was feeling too ill to attend proceedings.
One of Toffa’s bail conditions is he be present in court when ordered to do so.

The court then issued a warrant ordering his immediate arrest.

A bit of history regards Achmat Toffa:
Prosecutor Johan Swart opposed Toffa's application, saying he would interfere with and intimidate prosecution witnesses if released on bail.
Swart produced to the court an affidavit in which co-accused Johan Frederick Coetzer claimed Toffa called him on a cellphone from Pollsmoor Prison and threatened to kill him if he told the truth about the murder.
Toffa had a propensity for violence and no qualms about making a threatening phone call from prison, he said. The State had a constitutional duty to protect the public, Swart said.

Defence attorney William Booth told the court Toffa was from Bo Kaap, where residents supported his release on bail. Booth said Toffa was not a threat to the community, and referred to a petition on the court record, signed by Bo Kaap residents, demanding his release.

After bail was granted:

Toffa, who was out on bail of R15 000 in the murder case, was prohibited from contacting witnesses.
He was arrested at a house in Royal Street belonging to one of the witnesses in the murder case, the charge sheet states.

Then Toffa gets off the gun charge:
One of the four men accused of murdering Bronx nightclub owner Bruno Bronn has been acquitted of a separate charge in connection with the illegal possession of a firearm and ammunition.
Cape Town Regional Court magistrate Wilma van der Merwe found that there were “gaps” in the State’s case and the prosecution had not proven its case beyond reasonable doubt.

It was alleged that while Achmat Toffa was out on R15 000 bail in connection with Bronn’s murder, he violated a bail condition which included that he not make contact or interfere with State witnesses.

Toffa, 36, of Bo-Kaap, was arrested at the Maitland home of one of the State’s key witnesses in the murder case on September 8 last year. Police, acting on a tip-off, apprehended Toffa and searched the car he was travelling in. They found an unlicensed firearm and ammunition.
Toffa’s lawyer, Nawaal Abrahman, said during closing arguments that the firearm was found on the back seat of the car and did not belong to Toffa.
Abdurahman argued further that Toffa was not the owner of the vehicle, had not seen the gun and was not the last person to drive the car.
“If there is doubt, (Toffa) should be given the benefit of the doubt,” Abdurahman submitted.

Van der Merwe said in her judgment that if she “read between the lines” Toffa was involved in the offence.

Bronx murder accused forfeits bail

Bail of R15 000 granted to one of the three men accused of murdering Bronx nightclub owner Bruno Bronn has been withdrawn as he has violated almost all of his bail conditions.
Western Cape High Court Judge President John Hlophe ordered on Monday that Achmat Toffa’s bail be withdrawn and that he remain in custody for the rest of the trial.
Prosecutor Carine Teunissen told the court that a warrant had been issued for Toffa’s arrest because he failed to appear in court two weeks ago.
Toffa had also not reported to the police every day and had not remained under house arrest at his home in the Bo-Kaap.

Judge Hlophe was not convinced and revoked Toffa’s bail.
The case continues on Wednesday.

This Achmat Toffa (who's release on bail was DEMANDED by residents of the Bo-Kaap) is pure scum.
Despite all this going on around him, his family continue to pedal drugs in Greenpoint !

Why did they demand it? Is Bo-Kaap not a muslim area? Why would they want a drug dealer out and about in their area?

It is a muslim area - Toffa, too, happens by chance to be a muslim.
It was demanded, as he is "good member" of the community - despite being a high-ish ranking member of the 26s gang.

If you do a bit of research as to the main drug dealers & kingpins & who is at the top of the gang hierarchy in cape town, you will soon see a common "religious" denominator.

This is going to be an interesting, dirty & "scandalous" case if it goes to trial.

There appears a very very very large amount of cash - that seems to have vanished into thin air - and simply not mentioned, or known about by the media as yet for some reason.
Also quite a bit of sex-for-sale involving leather & cameras.

But best I shut up now before I vanish off the face of the planet

Sorry ... I am not familiar with this case. So this guy is responsible for selling drugs in gay clubs and selling sex etc? That cant be Halal surely! :whistle:

What i know & understand:
Frederick Coetzer "sort of" worked for Bruno Bronn at Bronx.
He was also a frequent "overnight visitor" to Bronn's house in Ocean View drive in Greenpoint.

Bronn had claimed for a few weeks (to a number of people) prior to his death that coetzer had threatened his life.
Neighbor sees Bronn arrive home with people in his car.
Noise disturbance during the night, neighbor goes to Bronn's house to investigate / complain.
Coetzer answers the door & tells neighbor all is well, noise is just the tv.

Following morning Coetzer is seen in Bronn's BMW outside somebody's home (now a state witness)
Later same morning Bronn's housekeeper arrives to find Bronn strangled on the floor.

Bronn's car is traced to the home of Kurt Erispe (now one of 48 state witnesses).
SAPS arrest Eripse then Coetzer, Achmat Toffa & Fareez Allie.

A friend of mine's uncle is at the very very top, the pinnacle of one of the gangs here in CT.
A few yrs back this person was in the high court for multiple charges - drugs, extortion, murder etc etc.
Eventually thanks to police making a total balls-up, he was acquitted.

Friend joyfully tells me (at the time) his uncle now goes to mosque every day to pray.
I ask friend "is it still business as usual" for his uncle - response was the expected "yes".
So I say to friend "is that not somewhat hypocritical, even blasphemous, to go to mosque every day to pray, knowing full well you are going to deal drugs, steal, etc etc the following day.
Friend shrugs shoulders

Go figure !

This guy must be a very good frekking friend! I would rather not associate with someone like that. Just now you do something he dont like and he gets Uncle Mohamed to come and smash your knee caps in. :eek:
 
Bronx murder trial postponed

THE trial of three men accused of murdering nightclub owner Bruno Bronn will not go ahead until next year.

It was scheduled to begin in the Western Cape High Court this week but was postponed twice – on Monday and again yesterday.
“We’ve wasted a lot of time in this matter,” Judge President John Hlophe said after provisionally postponing the start of the trial to February 3.

The trial was first expected to kick off in August but has been delayed several times since then. Among the reasons for this was that two of the accused changed lawyers.
In another instance, accused Achmat Toffa failed to turn up for court, with his lawyer saying he’d been ill.

When the matter came before the court on Monday, it was postponed until yesterday because Toffa hadn’t consulted his lawyer and another accused, Johan Frederick Coetzer, did not appear because he was facing a separate charge in a lower court. This charge has since been withdrawn.
Toffa’s bail has also been withdrawn for flouting his bail conditions, which include reporting to the police daily, house arrest (apart from when he was at work) and having no contact with witnesses.

In court yesterday, Toffa’s advocate, Nicolett McKenzie, withdrew as his legal aid lawyer. She did not give reasons for her withdrawal.
State advocate Carine Teunissen said a postponement was needed because it would take time to sort out legal representation for Toffa.
The State and the defence lawyers for Coetzer and Allie all indicated they were ready to go to trial.

While Judge Hlophe previously indicated that “urgency” should be attached to the case, he said yesterday that in the circumstances, it could not proceed because Toffa had the constitutional right to legal representation in light of the seriousness of the charges.
He set a February 3 provisional trial date and postponed the matter to December 2, allowing time for Toffa to secure a lawyer.

Bronn, 'killer' were 'partners' : Witness

Cape Town nightclub owner Bruno Bronn and a man accused of his murder were sexual partners, the Western Cape High Court heard on Wednesday.

"It was common knowledge. It was more than just a relationship. It was a working relationship and a sexual relationship," said Dawid Human, who worked as a DJ at Cape Town's gay night club The Bronx for four years and helped out with maintenance.

He was referring to Frederick Willem John Coetzer, who he identified in court as a bouncer at The Bronx.

Coetzer, Fareez Allie, and Achmat Toffa have pleaded not guilty to charges of premeditated murder and aggravated armed robbery.

The men are accused of killing Bronn, 50, in his Green Point home on February 7, 2012. According to the indictment he was strangled and died of suffocation.

A fourth suspect, Kurt Erispe, has become a State witness.

Human said The Bronx closed down about a week or two before Bronn's death and the manager had asked Coetzer to leave the club a month or two before that.

"I know in the last two weeks [before his death] Bruno wanted to end the relationship."

Human identified Toffa in the courtroom and said he had seen him alone at the club and with Coetzer. He did not know Allie.

Carien Teunissen, for the State, asked whether Bronn ever did his own maintenance work.

Human replied that either he or Coetzer helped him out with maintenance. Bronn had a tool kit in the kitchen pantry.

Teunissen asked what he thought of a policeman's evidence that a hammer, rubber mallet, and chisel were found in Bronn's main bedroom.

"That's very odd," Human replied.

The trial continues.

Murder-Accused 'fabricates events'

The first of three men on trial for the murder of gay night club owner Bruno Bronn, was accused on Monday of fabricating events.

Frederick Willem John Coetzer was queried by Arno Nell, for accused number two Fareez Allie, about his version of events on February 6, 2012 when Bronn was strangled.

"I put it to you that you are fabricating this story," Nell said.

Coetzer, Allie and Achmat Toffa have pleaded not guilty before Judge President John Hlophe and assessor Jaco van Reenen, a retired chief magistrate, to charges of premeditated murder and robbery with aggravating circumstances.

Bronn owned the night club, The Bronx, in the Cape Town, and was strangled in his Sea Point home.

Coetzer, a bouncer at The Bronx, was questioned at length about his relationship with Bronn.

He said he had enjoyed a good working relationship with Bronn, but denied that the relationship was sexual.

Coetzer s******ed at suggestions that he was homosexual or bisexual.

He added: "Bruno was HIV-positive, but always had respect for me and never tried anything with me."

Coetzer was warned several times by the judge not to be argumentative.

The judge explained that Nell's function was to cross-examine Coetzer, and Coetzer's role was simply to answer the questions.

The judge asked Coetzer pointedly: "Did you have a sexual relationship with the deceased or not?"

Coetzer said he had not.

Nell said Bronn had told four people about his sexual relationship with Coetzer, and asked why he would have said so if it were not true.

Coetzer replied: "I do not know."

Nell said that, according to Allie, Coetzer had boasted about having a relationship with "someone in an affluent neighbourhood".

Coetzer said he had not told anyone of any sexual relationship with Bronn.

He said the closest, physically, that he had ever gotten to Bronn was shaking his hand two or three times in the seven years that he had known him.

"It could be that Bruno told others that he had a sexual relationship with me, but if he did it was not true. I never slept with him," he said.

Nell said Bronn had complained that Coetzer repeatedly harassed him, and had said he was terrified of Coetzer.

Coetzer said Bronn was in fact terrified, but not of Coetzer.

He added: "The first time that I ever heard that he was terrified of me, was here in court.

"If Bruno had a problem with me, he would have discussed it with me himself."

Questioned about the happenings on the night in question, Coetzer said he visited Bronn to discuss problems concerning traveller's cheques.

He was dropped near Bronn's home by his co-accused, and inside the house Bronn had "rolled himself a joint" as they discussed the cheques.

He said Bronn got a fright when Allie suddenly appeared and gave Coetzer a firearm, with the words, "keep him (Bronn) here, and keep him quiet".

Coetzer said Bronn tried to struggle past him, and Coetzer grabbed Bronn around the neck to restrain him.

He said he managed to "disarm" the firearm, and in the struggle they both fell to the floor.

At one stage, Nell asked several questions as one, prompting the judge to intervene.

The judge asked Nell to break his long question into several smaller ones, and added: "I don't want this case to be converted into an Oscar Pistorius trial."

The trial continues.
