Public Protector Thuli Madonsela apologised to IEC chairwoman Pansy Tlakula on Monday for sending her a report about a probe into alleged irregularities at the Independent Electoral Commission late.

"To advocate Tlakula, I apologise that you received the report in the early hours of today [Monday]. I apologise unreservedly," Madonsela said at a media briefing in Pretoria on Monday.

Madonsela was releasing a report on an investigation into allegations of maladministration and corruption relating to the procurement of the Riverside Office Park to accommodate the head offices of the IEC.

In a statement, Tlakula said she received the report on Monday morning.

"Despite many requests to and assurances from the public protector that I would have access to the final report on alleged irregularities around the procurement of the IEC's offices in Centurion at least one day prior to it being published, I only received it at 04:00 this morning [Monday]," Tlakula said.

"It has left me with minimal time to critically review this document before she releases it to the media."

Tlakula said she tried to "engage extensively" with the protector "throughout the process on matters relating to her investigation".

"These include, gross procedural irregularities in the conduct of the investigation, errors of fact and law, abuse of power by the public protector leading up to the compilation of the provisional report and submissions on legal principles regarding conflict of interest.

"I hope that she has given due regard to my submissions.

"I will review the report and issue an appropriate response as soon as I have done so. I believe that because of the nature of the work that the IEC does that the findings of the public protector's report, should be given proper consideration before I respond."

I have yet to come across a civil servant apologising for any kind of tardiness or omission or mistake on their side. Their main aim is usually to shift the blame.
 
Tlakula did not disclose relationship: Protector

IEC chairwoman Pansy Tlakula failed to disclose her business relationship with a co-director who had a common interest in Lehotsa Investments, Public Protector Thuli Madonsela said on Monday.

"The ideal way that advocate Tlakula could have mitigated and managed this conflict was through declaration of the relationship and recusal from the procurement process," Madonsela said at a media briefing in Pretoria.

"By her participation in the procurement process involving her chairperson and co-director where they have a common interest... her independence and the objectivity in the entire process may have been compromised."

The protector found Tlakula guilty of improper conduct and maladministration.

Madonsela had investigated allegations made by United Democratic Movement leader Bantu Holomisa, including suspected irregularities in the procurement of the Riverside Office Park for the IEC's head office, the validity of lease agreements entered into by the commission, and various payments to Abland.

There were further allegations of a conflict of interest between Tlakula and Parliament's finance portfolio committee chairman Thaba Mufamadi, who is chairman of Manaka Property Investments, which owns a 20 percent stake in Abland by virtue of their co-directorship in Lehotsa Investments (Pty) Limited.

Madonsela said allegations about a romantic relationship between Tlakula and Mufamadi were not investigated as they were not backed by anything tangible.

She said the whistleblower employee denied the allegation when interviewed by the protector.

On request by Mufamadi, Madonsela omitted details about the alleged romantic relationship.

Abland was awarded the contract to lease the Riverside Office Park building to accommodate the IEC's head office.

"Tlakula was highly involved in initiation, evaluation and adjudication of the bids for the procurement of the building," said Madonsela.

"Adv Tlakula failed to declare her business relationship with Mufamadi to the team that had to evaluate the bids."

The IEC is a branch of the ANC and trust me, Mugarbage has let Zuma in on all his dirty tricks for winning an election. This I am sure of
 
Tlakula: I will not resign

JOHANNESBURG – Independent Electoral Commission (IEC) chief Pansy Tlakula says she will not resign.
Tlakula was speaking in response to a report by Public Protector Thuli Madonsela which found her guilty of maladministration and misconduct over the IEC’s acquisition of a new R320 million office in Centurion.

In 2011, UDM Leader Bantu Holomisa asked Madonsela to investigate the corruption allegations against Tlakula.

Speaking to Talk Radio 702's John Robbie, Tlakula denied the allegations against her saying she will not resign or step aside until the matter is resolved.

“I am not going to resign until the people who have appointed me tell me to do so. I think the Public Protector’s report must be put under scrutiny.”

She said the report will not compromise next year's elections.

“The IEC will still run the elections in the way it has. It’s simply that these negative publications and allegation are damaging to the institution.”

Madonsela also found that Tlakula failed to disclose her business relationship with Thaba Mufamadi, a co-director involved in the property deal and has recommended that President Jacob Zuma take urgent steps against her.

The IEC had initially decided to award the lease contract to Menlyn Corporate Park, but Tlakula later expressed her dissatisfaction with the decision and the decision was made to sign with Abland.

While Tlakula admitted she had a business relationship with Mufamadi, she denied any romantic involvement with him.

“I have a business relationship with him, but not in the company that tendered for the property.

“If I am involved in a company that has submitted a tender and I am not going to get any financial benefit from the transaction that arises out of the tender. Is that a conflict because that’s what I want the court to decide.”

She also said no IEC policies have been contravened.

She said she is “surprised” by allegations that she is romantically involved with Mufamadi.

Tlakula said Advocate Madonsela received an anonymous defamatory complaint about this matter.

“It’s not true, because she even called somebody who denied the allegation.”

Madonsela described Tlakula’s conduct as an “unmanaged and undisclosed conflict of interest” and said the consequences included significant damage to the reputation of the IEC.

Madonsela says although there is a genuine need for a bigger building, for a more reasonable price, the process was flawed.

'TLAKULA MUST BE SHOWN THE DOOR'

Meanwhile, several political parties are calling for Tlakula’s suspension.

The Congress of the People (Cope)’s J.J. Abrie says the contravention of the procurement prescripts raises eyebrows and could have an impact on public confidence.
“We don’t believe they can be trusted in overseeing an election campaign if they can’t oversee the renting of an office.”

The Democratic Alliance’s Manny de Freitas is calling for an urgent meeting with both Madonsela and the Chairperson of the Portfolio Committee on Home Affairs.

“If it’s found conclusively it was corruption or mishandling, certainly she should be fired.”

Holomisa also welcomed the findings.

“She should be shown the door with immediate effect.”
