Mosery said it was the duty of either the municipal manager, Co-operative Governance MEC or speaker to verify whether councillors met all constitutional requirements to serve in public office.

Since Makwarela was the Speaker maybe he gave himself the green light to remain? I wonder what is the implication on the other officials mentioned?

Not sure. But apparently, either the MM or the Gauteng COGTA MEC should've looked into it (excl. Makwarela as Speaker).

COPE spokesperson Dennis Bloem said the party was caught by surprise when confronted by media with the news of Makwarela's disqualification.

“As the national leadership we were not aware of this serious violation of the law. In all fairness and honesty, during the filling in of the declaration forms to stand as a candidate to contest the election, Makwarela declared he was sequestrated,” Bloem said.

Once again, a "Which COPE?" question arises here.

Perhaps COPE GP (which COPE faction are they? IDK anymore with these okes), didn't care and allowed Makwarela to pass?

True, I wasn't being serious, although him being a Speaker could have worked in his advantage if the MEC or the Municipal Manager were sleeping on the job, he was not going to rat himself out.
