Yes, everyone knows the challenges of those NGOs who are always taking the government to court and promoting lawlessness, that happens but it doesn't in any way change the fact that the municipality owns sidewalks and is therefore responsible for their maintenance.

Why don't you prove it then? This isn't some random building in town.

Your house and the land around it belongs to you(or your landlord, you probably just rent , or is sectional title common property.) Up to the boundary wall/fence.

The road reserve doesn't stop at the side of the road. It stops at the boundary wall/fence/property border and includes what is commonly described as the sidewalk.

I'm telling you that response is a lie, because no mayor is that stupid.
 
Maybe back then but I would be very surprised if the necessary handover was not done ages ago, imagine what a mess it would be for the city and service providers in terms of infrastructure.

I have a feeling that the mayor was speaking in general here pertaining to the actual property, the sidewalk will most probably be something they can deal with.
Well would be relatively easy to show... If someone has access or knows the link to the Capetown gis system.

**EDIT** Ok I can see where this gets "tricky" for the city.

Yes the sidewalk is city property, but the boundaries of the Castle are not the boundaries of the DoD land, there are places where the castle walls are stepped back from the boundary of DoD property and we all know the military likes to overstep its boundaries so I can imagine the City has a tough time enforcing things where that delineation becomes "grey"

That's not exactly true. Depending on what you mean by maintenance.
Eg. Most municipalities don't cut the grass but they do trim the trees occasionally, and can get funny about it if you cut the trees down yourself.

But they certainly can if they want to.

Same thing. There is no other way property or road reserves works legally.

I'm telling you the DA can clean up these areas, and I'm not arguing anymore. If you like to believe they can't, then good for you.

Okay, let's put it like this to avoid any further confusion, the sidewalks on municipal roads are the property of the municipality, yes people maintain and make them beautiful in front of their houses, but who is responsible for dealing with the sidewalks elsewhere in public spaces under municipal control where there are no residents to do the maintenance, yes it's the municipality, unless the road in question is a provincial road, which the provincial roads department would be responsible for.

So in short, municipal property, which they can maintain or not maintain as they feel fit.

I would think there is an exclusion zone as well around a DOD property.
 
Here it is, and as I edited my Post I can see why it gets tricky, but also GHL was being a bit "loose" with the truth it seems

Yeah, I don't think there was any intention of malice from the mayor, as I said he was most probably responding in general about the state of the actual property.

The municipality can definitely go and clean that up. It is not like the DoD is going to come out and argue that a shack/homeless tent thing is 50% on their property.

This is only a problem for the municipality if they want it to be, if they are begging the DoD to clean it up.
 

The prospect of a coalition was expected and welcomed by 47.8% of respondents, while 32.7% were sympathetic to the concept and 11.5% were lukewarm. About 7.5% strongly opposed the idea.
Apparently, 80% of respondents want/are open to a GNU involving ANC/DA...

its not as simple as you think.
the city has no legal right to do anything on dod land.

if they tried, they would soon be facing a legal battle with some ngo representing the homeless - and the case would be quite simple, coct has no legal right to carry out evictions on property not owned by the city.
