In a victory for three officials who challenged the Nelson Mandela Bay Municipality’s employment equity policy, the metro has backed down and wants to use a different set of demographics to hire staff.
The officials said the policy – which was based on national rather than local racial demographics – was unfair and discriminated against people who were not black Africans.
The municipality will also no longer oppose the officials’ court challenge.
Instead, it will ask Labour Minister Mildred Oliphant to promulgate a law that local demographics for municipalities be used for employment equity.
The officials – Willie Blundin, Dean du Plessis and Allister Jordan – turned to the Labour Court in June.
They said the municipality’s new employment equity plan, for 2013 to 2018, was geared to benefit only black Africans and did not reflect the racial demographics of the metro.
The plan resulted in the city reducing its employment target for coloured staff from 23% to 13%, for whites from 14.36% to 10.5%, and for Indians from 1.11% to 0.8%.
That meant that while black Africans comprise about 60% of the metro’s population, the municipality increased its workforce targets to 75% black Africans.
