Traffic fine - advice needed.

Thanks Sinbad, certainly interesting reading. As these times seem to be recommendations I wonder what the chances of success would be in getting a short timing robot fine cancelled by the Public Prosecutor on the basis of this document?

I suspect if he made a representation saying that the yellow time was shorter than the recommendation and taking into consideration the very short time after the red signal that he went through, the prosecutor would, if not in a really bad mood, be convinced to either reduce or cancel the fine.
What were the conditions like? Dry?
Is the road flat or a hill?

I'm going to take it on. Now should I wait for the summons or take it to them in a letter, because it seems like I'm probably going to be out of the country for the rest of the year?

If it were me I'd see if it were possible to see a prosecutor in person. Don't wait, get it sorted out before they invest more time and money in summonsing you etc.

I think it was dry, but the for sure the road is flat.

Cheers, will do. Thanks for the good advice.

After going out and timing the lights and doing a bit more reading, I found it difficult to explain to my daughter what I was talking about, so I threw this together to give a visual on the situation and it really highlights how unfair this intersection is.

Any comments?

VICTORY

After visiting the traffic department back in May and presenting the findings, they promised an investigation which is now complete. The local newspaper took up the story also, and over the following weeks the letters page was full of stories from people who had also been fined.

Now the findings have been released and they have finally admitted that the timings are indeed out :)

Unfortunately the issue of the fines is still outstanding and apparently the individual recipients will have to wait for a summons before arguing the case in court.

I'll wait for a summons (if one ever comes), but the damage is done and the local paper ran a follow up story this week saying that the traffic department have admitted the fault and hopefully now they lights will be changed and the fines dropped.

Thanks for updating, this will is a valuable thread

There's no court date. The offence took place on the 3rd December and the fine had to be paid on the 2nd February. I got the notice yesterday in the post :wtf:

The notice only gives the location and says the vehicle was travelling at 62km/h in an 80 zone.

I'm going to go and time the light later today because that 1.5 seconds was a count done at Christmas time when my wife and I actually noticed the light was changing so fast that it seemed abnormal. We didn't know we had a fine back then though so it shows you something was up.

What is the processed date on the fine. If it exceeds 30 days it's invalid. ie: Date of fine 3rd December processed 4 Jan equals invalid.

UPDATE.

First, the lights were changed some time ago and now the timings are apparently within the limits, although I haven't timed them myself.

Second, I just received an sms with the message that a summons has been initiated for a traffic fine. Or of course, pay the R2000 fine :erm:

So, it looks like it's off to court I go. In the meantime I have emailed the traffic chief asking for the findings of the investigation that led to the lights timings changing.
