Traffic Fine Redirection

Hi guys,

I received a fine recently, and I was not driving the vehicle when the fine was received. My cousin was driving, and he was on holiday here. He is not a SA citizen. I sent the relevant traffic camera office (I would never have thought that speed enforcement was such an important part of our traffic departments, to have a separate office /sarcasm) all the required documents, to get the fine redirected, but the department refuses to redirect the fine to a foreign citizen. As far as I understand, this should be possible, but being no legal expert, I would like to get some more information.

Does anybody know some lawyers or attorneys who would deal with something like this in the JHB area? I would like to get some kind of legal opinion to determine whether there is anything that can be done about this problem.

You may have more luck trying to get the money out of your cousin, and paying it youself... Much less hassle imho!
 
You need to take that information to the prosecutor at the magistrate's court. I would draft it in the form of a detailed letter to give to the prosecutor. Include all the relevant details and proof if you have any. Give the foreign address if you can.... and a passport number if he has one. Maybe also a local contact number. The prosecutor should withdraw the fine for you.

haha, yeah did that. The Traffic camera office refuses to redirect it to a foreign citizen. I have been forced to get lawyers involved, and they say that the prosecutor doesn't stand a chance. Will see what happens.

The traffic camera office is not the same as the public prosecutor. The prosecutor has to determine whether or not the offence warrants the court's time or whether there is a significant chance it might be denied.

The camera office is administered by the traffic department, the prosecutor works for the state. If you can show him sufficient reason for why this case will be denied he will simply pull the file from the roll in order to not waste everybody's time.

The traffic departement will be all for the case, but the prosecutor has to deal with facts, and if there is a strong likelihood that this case is going to be lost, he does not want the court's time. The judge could castigate the prosecutor if he allows an unwinnable case to be listed on the rolls.

hehe good to know... with respect to the guys who suggested paying the fine, I end up paying enough of my own fines. I will rather pay a lawyer to get me out of the fines than give those scum-bags any money.... ;)
 
You're not going to get around paying imo.

The person in whose name the car is registered gets the fine. And I doubt that "my cousin who is conveniently out of the country atm drove" is going to fly.
