Traffic fines

Good day guys

I am in a kind of a situation and I was wondering if someone can please point me to the right direction.

I managed to get a couple of speeding fines for my vehicle, thanks to the mobile speed cameras. The vehicle is registered in Malmesbury,Swartland Municipality. The license disc is due for renewal end of April, I went there and asked them if I can be allowed to renew the disc and the answer was no, I need to pay the fines first.

I acknowledge the speeding fines and take full responsibility for them, I will pay them when I have the money, but not now. This does NOT seem right, they cannot stop me from renewing the disc because of fines.

What can be done in this situation?

Do you have warrants of arrest issued? If not you will be able to renew the disc at the civic center.
 
I've heard of this happening but never seen someone experience first hand.

Personally I would take the renewal notice (if you receive it), or fill out the renewal form at your nearest SAPO that offers licence renewals.

I have had multiple speeding fines in the past across multiple cars, and never had issues renewing licences. Durban though.
 
I've renewed my licence plenty times without being asked about my outstanding fines, but the last time I did it I also had to pay my fines first, which wasn't quite planned.

I'd also like to know if there is a way to renew without having to pay the fine

I've got a few unpaid BS fines to my name but it's only the SUMMONS (or, as in my case, the failure to appear + associated fine notice :o) that will prevent you registering (or selling!) the car.
 
I don't see how they can stop you from licensing your car if you have outstanding fines. A fine is an allegation of wrongdoing, it is not proof until you either admit guilt by paying it or are found guilty by a court. If you have not yet had your day in court then you are not guilty of anything. By forcing you to pay your fines they are forcing you to admit guilt before you've even had a chance to challenge the allegations against you in a court of law.
 
Pay at the post office, won’t ask you to pay your fines.

At least they haven’t asked me and I know I’ve had fines outstanding
 
I've been able to renew my license online in the past while still having outstanding fines. You could give that a go.
 
First of all, By law your fines are with the traffic department and not with the office/municipality where you renew your license and they are legally not allowed to withhold it from you.

Secondly when it comes to fines and warrants of arrest they have to give you that in hand, also they have to prove that they have made 3 repeated attempts to reach you and failed to do so... Even if there is a warrant for your arrest if they have not had it delivered to you in person meaning they have not have you signed that you are aware of your summons/warrant then its invalid. Again they have to prove that they have attempted to deliver your fines and failed and had reasonable grounds for your summons and it was delivered and confirmed that you had received it an were aware of it and should you fail to make the appearance in court being aware then the warrant for your arrest is valid.

Otherwise if you fail to appear in court for a summons you were not aware of the warrant is invalid because they cannot prove that they delivered your summons and that you were made aware.

The only problem I did have, was last year, when I bought my son a car, on my name. Barons called to say that there was one outstanding warrant on my name, which needed to be paid before they would register the car. Just went to Gallow Hills - Paid R800.00 and the car was registered the next day. (can't believe there was only one warrant!!!)

I have till date only ever paid 2 traffic fines in my whole life.

1. I just got my license and was a scared old 18 yo.
2. About 20 and got a fine in my mother's car in a town called Kathu. I just drove straight to the police station and paid it same time.

Police rocking up at your door? No problem, bring it!
Getting handcuffed and shoved in the back of a police vehicle? No problem, bring it!
Spending the night in a prison cell with a whole bunch of other unmentionables? No problem, bring it!
Incurring the wrath of your mother? OMG, pay the fine now!!! :D

That was 18 years ago and I still learned how to drive. I have racked up quite a few since then. I just file them in my glovebox :D
I file mine straight in the dustbin

Hence the requirement for a Summons / Judgement.
 
Only ever paid 2 fines in my life... both had warrants of arrest issued so I paid them plus the contempt of court fee as well.... until they get to that point they can fsck off
 
Thanks guys for your input, I will give the Post Office a chance, seems like a viable option.
