AFAIK they may not add 5% or whatever to the final price if you pay by CC.

Also, shop around and see what you can get.

Thats illegal. You should report them.

The 12% on top of the 30%+cost sounds dodgy as well. How does that incentivise people to get the card? Sounds like a case for Carte Blanche...pop them a mail. They did a brilliant job about exposing the service centres last year...

If they are not registered merchants with any bank then yes they can charge the additional fee...because that is what the bank would charge them for accepting the card as a once off. You can negotiate the fee with them. I've seen some people split the fee with the merchant, and they don't take the full amount. Also have a look at their windows and till points and see if they have the mastercard, visa, diners, american express stickers. If they have the stickers they shouldn't be charging the additional fee.
