Hi

How does UIF work?

Basically at the end of this year my company is not renewing my contract. So come January I will be unemployed

So if I don't get a job, which I am looking for at the moment, by then would I qualify for UIF? and how would i claim it?

if you have been paying UIF surely you can claim UIF? And not getting your contract renewed sounds like retrenchment to me.

If YOU are the reason you're unemployed = No UIF.

However, if you're unemployed through no fault of your own = You can claim

Its worth looking on the Dept of Labour's website for the info. They are very helpful over the phone too. At a thumbsuck, I would say you should apply. It depends also on what is marked on your UIF card if you have one as a reason for the termination of employment. Retrenchment is the best option. Have a word with the HR person and ask him/her to mark your card accordingly. It makes no difference to them. To get full benefits, you must have been contributing for 14 months.

if HR lies thats means CCMA and stuff and i doubt the company has time for that

As long as your termination reason is specified as reason 05 - Contract Expired and this information is submitted to UIF by your employer, you should be able to claim.

This is the general rule for UIF benefits:

if you pay UIF you can clam UIF . . . if you are a contractor or not . . .

You cannot claim if you have resigned, been suspended or absconded from work, unless the particular resignation is deemed as a constructive dismissal by the CCMA. You can only claim for UIF if your employment contract has been terminated, your fixed contract has expired without renewal or your services are terminated as a result of the employer being insolvent.

Awesome advice people. Thank you. So it looks like I will be able to claim.

Does any1 know what the % of your current salary you will receive?

Depends on how much you earn, you can claim anything from 38 - 58 % of your salary. The more you earn, the closer to 38% it will be, the less you earn, the closer to 58% it will be. In other words, in theory they try to pay everyone out the same amount regardless of what you earn. Lower earners = Higher %, Higher earners = Lower %.

Go to the dept of labour (UIF offices) & there's a form they must give to u..i think its also on their website. You take that form to HR & get it completed & take it back to Dept of Labour.

There's also another form that you must fill in yourself & another one which you must get a bank stamp on it.

After filling in the 3 forms, you go back to them & take your ID & latest payslip with u.

Submit the forms & (if your application is approved) they will give you a date when you need to sign *release papers*, your first payment is released within 2-3 days after signing those papers. They will also tell your next signing date.

You can only claim for 6 months & you have to sign the release papers every month to show that you are still unemployed.

You will end up with about a 25% of your salary, with an upper limit of something like R12000...it is a massive schlepp getting UIF. I suggest paying a company a fee too collect on your behalf. Start the process TODAY, otherwise you will start seeing money only next year February if you are lucky.

Correct - there is a limit (R12500) I believe

Make sure that you go to UIF as soon as your contract ends. If you delay, you will not get the full six months.

You get for whatever period you were unemployed even if you're already employed again by the time they have processed your application.
