Yea if she was only consenting to the sex based on you being who you claim to be then I think it would be difficult to argue that it wasn't rape. You would need to argue that informed consent was given and frankly she was informed that you were Brad Pitt when in fact you weren't.

Aside from these two personas you can be anyone you like and get away with the rape.

I think it's if you pretend to be someone else and the girl consents. If she doesn't even if she thinks you're her boyfriend it will still be rape.

If you want sex from someone ask them and make sure you get consent. Don't just stick it in while they are sleeping. Sounds like rape to me.

I of course wasn't referring to those in an established relationship. At least there you have a reliable history of informed consent, that is different to when you do it to a person you do not currently have a sexual relationship with.

It's very iffy to me. It just can't logically be rape to me. It's fraud. Something completely different. The fact that you can get convicted for rape and not fraud is just off.

There are thousands of Rapes that go unreported in South Africa almost every day!
Here we are worrying about one girl in the USA because of some archaic loophole, when we have thousands of people raped here every day and it never even gets followed up, never mind any loopholes.
I just find it ironic that people find this news worthy.
The attitudes towards rape in this thread are indicative of the problem in SA.
