I need some advice. Two months ago my wife took out a Blackberry contract on got a herself a pink BB handset. She had the handset for two weeks, when the pink "paint" on the back batery cover of the handset started to splinter off, leaving the white plastic exposed. We went to our local Vodacom repairs shop but they refuses to repair, refund or replace the handset, unless we pay a R150 plus shipping for the replacement cover or ... The Vodacom repairs man (Vuyo) at the Loch Logan Waterfront advised my wife to lie and say the device is "dropping calls", he will then send the device off to their JHB and have them send her a new handset, but she still would have to pay for shipping? I've tried on several occasions to get hold of "Barry" the owner of this franchise, but he just don't answer or return our calls. I'm I wrong to think that it is unreasonable for us to pay to obtain a replacement part, I'm not willing to risk following the ignorant Vodacom rep.'s advice and commit insurance fraud. Apparently there is no other Vodacom repairs shop Bloem. Any advice will be helpfull. Tnx!
 
Paint chipping off might be considered normal wear and tear damage, in which case it's unlikely to be covered by the warranty. This would be similar to claiming a warranty replacement on a scratched screen, not going to happen. If you're not willing to pay, I'm afraid you'll have to live with the chipped paint.

As for the insurance fraud, that's a totally different issue and will probably be very difficult/impossible to prove, unless you record the conversation or something along those lines.

id be pissed. and no, u dont have to live with the chipped paint

edit : could be a faulty unit. I have a black bb9780 for 2 years now & it still looks as good as new. May have something to do with the pink colour. check google
 
I would like to suggest that you resolve your problem in the following manner.
Make use of the Small Claim Court system but you need to prepare your case properly.
  1. Obtain two independent repair quotes/assessment reports in writing at your cost.
  2. Then approach the Clerk of Small Court to assist you with preparing a summons for the business owner.
  3. Once an court date is arranged then approach your local newspaper to send an reporter on that date.
In the event the Small Claims Court Commissioner rules in your favour and the business owner does not comply with the ruling, arrange with the Sheriff of the Court to seize goods to the value of your BB plus Quotes costs from the business to sell in order to recoup the expense.
Remember it does not pay play with these cellular business. Worked for me over and over and it is what these owners do not want, I had one instance where the Sheriff seized the Telephone Exchange and all Fax machines - worked wonders.
 
Thanks guys! I'll attempt to get hold of the franchise owner on Tuesday again, if i'm unsuccessful, I see no option but to seek legal assistance and get the contract canceled and migrated to another provider, they hoped that by making it as difficult as they possibly can, we would give in and pay, but this is something I can't and won't let go.

Okay, so the owner is dodging, and have not responded to the voice messages and SMS communications I sent him, so I headed back to the store and got to speak with Tom, whom said the paint rubbing-off constitute physical abuse. ?? cleverly Vodacom have a little built in a disclaimer in their contract application forms for this. It seems the pink handset is inferior to handsets of other colors, as rubbing the handset's battery cover make the paint come undone. I ordered the cover from Tom, whom said he'll have it in stock by Friday, and I have pay 150 bucks for it. I'll see what I can do to get my money back, as long as wife is happy for now. I advise anyone considering a pink BB to reconsider.
 
So stoked! my faith in Vodacom has been partially restored, the Repairs Manager, Tom, had ordered the faulty battery cover and handed it to me free of charge!!
